Help? Employers responsibilites RE: Employees on Sick Leave

As most of you know, I've been on sick leave for the past three months due to stress related illness. My employer will not pay me sick pay, therefore has to provide the Department of Work and Pensions with an SSP1 form so I can claim Incapacity benefits etc until I am well enough to go back.

They haven't done this.

I have spoken to my line manager, his manager, Payroll, HR and my Benefits Advisor. My advisor told me I'm not the only person having issues with my company, but there's not much they can do. Isn't the provision of an SSP1 a legal requirement? I've made an appointment with the Citizen's Advice... people... but other than this, is there any action I can take? We're going broke (literally down to our last few pounds) and its making me really ill.
 
Personnel law and labor relations was my specialty when I went to college (university for you), and if you were over here, I could help, but I'm clueless when it comes to UK law....sorry. :(

No worries, its just really, really frustrating. I'm sick of the bloody Benefits people phoning ME to ask where the form is. I. DON'T. KNOW!
 
Get your own SSP1 from the social (I'm not certain if you have to fill any of it in yourself) and send that in. Hand delivered is ideal, or recorded delivery would be a good idea.

Then tell the dole you handed it in and chase up the employer every ten minutes.

ETA. Tell your local councillor and your MP (is it still Bill O'Brien?) MPs really are pretty good at kicking arse.
