No they are not the same.
It's not about him being elected or being "legitimate" or not. It's about his family's personal stake in American government.
We should be able to know if he is indebted to certain countries before we let him dictate foreign policy. He should show complete transparency in his business holdings and operations to avoid even the appearance of conflict of interest.
The Russian scandal following him around looks all the more shady the more he refuses to disclose his finances.
In addition to that, it is part of our "democratic norms." Not required by law, but a show of good faith to the American people. He's pissing on that like he's pissing on everything else. "I'm above our democratic norms. I'm exceptional."

Who cares? Presidents are elected by the system operated by the US. If you get the wrong President blame the electorate, not the system.
