Desertion from the military is a very serious crime. It's covered under Article 85 of the UCMJ. AWOL is also a serious crime and is covered under Article 86 Absence without leave of the UCMJ. If Bush was actually AWOL, he would have been tried by a court-martial. When and where was such court-martial conducted? TIA.

Elements.

(1) Failure to go to appointed place of duty.

(a) That a certain authority appointed a certain time and place of duty for the accused;

(b) That the accused knew of that time and place; and

(c) That the accused, without authority, failed to go to the appointed place of duty at the time prescribed.

(2) Going from appointed place of duty.

(a) That a certain authority appointed a certain time and place of duty for the accused;

(b) That the accused knew of that time and place; and

(c) That the accused, without authority, went from the appointed place of duty after having reported at such place.

(3) Absence from unit, organization, or place of duty.

(a) That the accused absented himself or her-self from his or her unit, organization, or place of duty at which he or she was required to be;

(b) That the absence was without authority from anyone competent to give him or her leave; and

(c) That the absence was for a certain period of time. Note: if the absence was terminated by apprehension, add the following element

(4) Abandoning watch or guard.

(a) That the accused was a member of a guard, watch, or duty;

(b) That the accused absented himself or her-self from his or her guard, watch, or duty section;

(c) That absence of the accused was without authority; and Note: If the absence was with intent to abandon the accused’s guard, watch, or duty section, add the following element

(d) That the accused intended to abandon his or her guard, watch, or duty section.

(5) Absence from unit, organization, or place of duty with intent to avoid maneuvers or field exercises.

(a) That the accused absented himself or herself from his or her unit, organization, or place of duty at which he or she was required to be;

(b) That the absence of the accused was with-out authority;

(c) That the absence was for a certain period of time;

(d) That the accused knew that the absence would occur during a part of a period of maneuvers or field exercises; and

(e) That the accused intended to avoid all or part of a period of maneuvers or field exercises.
 
I'm not counting that as past-tense until January 20, you see. ;) I want to make sure that he follows the Constitution at least on that point.

Yeah, It took years to get over the Clintion "Legacy" and it will take more than 8 years to overcome the Bush Presidency. Trillions in debt, budget in dissarray, War in two fronts with no identifiable enemies and an economy spiraling down like a flaming B-24.

There are Dems now who are drooling over the chance to repeal the Second Amendment, or gut it so it just allows BB guns. There are also Dems rabid for the chance to amend the Fist Amendment so it only allows what they want it to allow. That would definitely eliminate talk radio.

Tilt. That's the big "If" that keeps this controversy alive. The fact that there are no records that George the Lesser completed his service and remembrances by those pulling duty with him that he didn't show up very often or stay very long. If you are claiming that court-martials have been conducted every time a junior got preferential treatment in the national guard because of the clout of senior, I'm afraid you'll have to hear me doing some horse laughing in your direction. But that concept is ever so cute.

How easily you deny Bush legal process.

John Kerry has discharge papers dated some six years after he was known to have separated from the service. The date of Kerry's discharge papers are from the Jimmy Carter amnesty program. There was not amnesty for those who already had an honorable discharge. Thus, Kerry initially had a less than honorable discharge.
However, due to the government's lack of certain records, Bush is accused of prosecutable offenses. Interesting, but not cute.
