A federal judge has struck down the Biden administration's mask mandate for public transportation.

US District Judge Kathryn Kimball Mizelle, in Florida, said that the authority of the Centres for Disease Control didn't extend to public transportation, and that the implementation of the mandate was a violation of administrative law, per AP.

In the ruling, Mizelle wrote:

"'It is indisputable that the public has a strong interest in combatting the spread of [COVID-19].'... In pursuit of that end, the CDC issued the Mask Mandate. But the Mandate exceeded the CDC's statutory authority, improperly invoked the good cause exception to notice and comment rulemaking, and failed to adequately explain its decisions. Because 'our system does not permit agencies to act unlawfully even in pursuit of desirable ends,' the Court declares unlawful and vacates the Mask Mandate."

Mizelle therefore wrote that "The Court DECLARES UNLAWFUL and VACATES the Mask Mandate, remanding it to the CDC for further proceedings consistent with this order."

Well it should be pointed out that the masks mandates were before there was a widely available vaccine. But that's recent history, how can we expect a right winger to remember what happed during the Trump administration. And it's not like Trump said he's "a believer in masks".

Bullshit. It shows nothing about the original invoking of the mandates done at in an entirely different cycle of the Covid crisis. At this time, within a few weeks of the extended mandates due to close out, it just means they are about to close out anyway so why waste the effort? Try not to be stupid about this.

They were already going to drop them in three weeks, so likely won't challenge unless they can get an injunction till that time.

Since it looks like the Biden Administration is not going to seek a stay, the HEPA filtration systems will have to do. Mask mandates on planes will not be coming back.
