At what point do you draw the line between someone who is mentally mature enough to make this decision? The laws are arbitrary lines to be sure, but in this case better to err on the side of caution.

You have a longer time to be an adult than you do to be a child. You can only claim childhood until you are 18 (depending on your local laws), you have 50, 60, or 100 years to be an adult.

Here in VA it would be considered Rape because he is under 18. I know alot of under age kids have sex but with you being over 18 I wouldn't risk it because if the mother decides to push it and you get convicted you become a "sex offender" and go on the sex offender national registry for the rest of your life. oddly enough i know too much about this subject.

statutory rape is when a minor is engaged in sexual intercourse by some one that is years older than them. the idea is that the minor is not of the age of reason to understand the consuqneces of their actions, even if they are of sound mind and give full consent. since they are not of a magical age to understand they are deamed too stupid by the state (depending from state to state) to engage in intercourse.

now, through this there are multiple loop holes depending on states, ages, and diffrences. in most states if you are 1 or 2 years apart then it is consentual because you are of the same 'age grade' (ie 17yo and an 18yo) it is weird because most of the laws applying to this have a weird 'grey area' between sex between 16-17 year old minors with 18-20 year old perpetrators. most state laws apply that if You are between the ages of 18-20 then anything below the age of 16 is illegal, where as if your 21 up then anything below 18 is illegal. its a weird law and it depends on how it is prosicuted from state to state.... here in missouri 17 is the age of legal consent. in alabama i think 16 is. new york and california are 18. but still there is a hazy grey area which leads to alot of confusion about the law when you are close in age between you and the other.


oh and i didnt say this but:
Statuory rape can only be convicted if their is absolute proof that it has been comitted, for instance if there is an eye witness, or the 16 year old gets pregnate. if there is no proof then there is plausable denial since sex is a hard thing to prosicute because it is a 'private' matter and you have the right to Not share your private affairs. Most lawyers wont take the case unless if there is absolute proof (she is pregnate) thats why you often hear of stautory rapists being men because the little girl got knocked up. rarely do you hear of women being prosicuted, although ive heard of a few, (most of the time it was mom walked in when the old neghbor was going down on my little boy.)

its rape if only because the law says the person is not of age to understand the choice. but you must also look at all parts of the law to fully understand what the 'law' is. every one just doesnt understand it ever since they made that movie 'jail bait' that aired on mtv or something stupid. jail bait is when you are 3 years or more apart. making it when your a Senior you cant date a freshman, that is what the movie implied.

a few posts up some one posted the sight which states the LAWS on the ages of legal consent thorugh out the world. take note. all the Laws in the United States All have 1 thing incommon, is prosecutable if one of 21 Years of Age engages in Intercourse of some one below the age of consent. Notice it says 21.

This leaves a huge Grey area from 18 to 20, why? Because if by legal law the age of consent was administered to one and all, then 18 and 17 year olds would ALL be commiting the crime.
