It's still a federal crime. Crossing the U.S. border illegally for the first time is generally a misdemeanor under federal law, specifically, under 8 U.S.C. § 1325(a). It can carry penalties like a fine, up to 6 months in jail, or both as well as deportation. However, if someone crosses illegally again after being formally deported or removed, it can become a felony under 8 U.S.C. § 1326, with much harsher penalties, up to 2 years in prison, and even more if they have prior criminal convictions. Many here illegally are committing felonious crimes against the American people.Crossing the border illegally is a misdemeanor. And illegal immigrants are less likely than native-born citizens to commit serious crimes.
