Clumsy Rip-Off

At another forum, I got this answer;

DMCA Notification of Copyright Infringement

You need to include:

* An electronic signature (your full legal name) of a person authorized to act on behalf of the copyright holder;
* Identification of the copyrighted work claimed to have been infringed, in the form of the original URL of the image or work being infringed upon;
* Identification of the material that is infringing upon your copyright, with reasonable information for the provider to locate the material (you must include the user name of the person who is infringing upon your copyright, and links to the allegedly infringing material);
* Information reasonably sufficient for the provider to contact you (a valid email address);
* A statement that you in good faith believe that the material is not authorized for use in such a manner;
* And finally, a statement, made under penalty of perjury, that the information given is accurate and you are authorized to act on behalf of the copyright holder.

They ripped off at least twenty of mine. I just skipped around and found that many, at least, and I would probably find at least 100. Do you think it would do any good to make a list of them and email the ISP provider? I'm actually sort of used to it by now but I never will like it.

I looked at the list of anal stories. They have pirated ten of mine, unless I missed some, but it bugs me that they didn't get what I consider my best, "Melissa's Gorgeous Ass". That might be a way to figure out when the wholesale theft happened because they should have taken that one too.

There was 19 of mine taken. Some entire series. :rolleyes: Glad to hear we have people here on the case as well as folks that researched where to send complaints! Thanks to all of you for doing that. I wouldn't have had a clue where to start. ~ Red :kiss:

I'm willing to let Laurel and Manu handle it, as much as they can, but hopefully, with the backing of all of us sending in complaints, they'll get the message sooner.

Here's my newest problem: Lucid Dreaming, the one they stole? It was under my old Lit account, and I just had it taken down about six weeks ago... Lucid Dreaming is no longer on Lit, and I really don't want it anywhere else either. There was a reason I took it down! So I can send everything the DMCA requires (and thank you, Stella, for rummaging around until you found what it was, because everything I found dealt with software and music) except the original URL.
 
It's a real chore, but I am going to search their site and send a list of the stories of mine that they have pirated. There will be about 100 of them. I will send a copy of the email to Laurel. :mad:

By the way, as to those pics of hot women who are said to be available in your area: I have dealt with Adult Friend Finder in the past. If you respond to any of them, according to my experience, all you will get will be SPAM inviting you to subscribe to porn sites. They do have some women who are actuallyh looking for companions and even sex partners but you will have to go to AFF to find them.

Well, they live somewhere and it might be in your home town. They probably look different on the site than they do on the street, unless you see them in a strip club or some such place.

Zeb, can you let us know if that works or if they bounce it back to you? I was thinking that they might be trying to go the "written-means-snail-mail" route that some other agencies go, but if they will take it by email I will (if you don't mind) borrow your format and send it tomorrow. If they insist on being pillocks and demanding it in hard copy, well, I can suit them with that as well.

Jammies, that's a great idea about getting advice from those with experience. I would love to know to whom I ought to be cc'ing my complaints.

Sure will. So far I have gotten and automated response, but I did the first time too, then a followup the next day which stated that I needed to provide the DMCA info. It didn't say it had to be sent my snail mail, only written. And I do have a copy I can fax to them just as well. And via snail mail if they really want it that way.
 
I sent all the info with urls etc and this is the reply I got back:

"I understand that, but as mentioned in my previous message if you want
the content taken offline you will need to submit a formal DMCA
Notification (this is a process provided under US copyright law providing
a means for service providers to respond to copyright issues without
exposing themselves to unnecessary legal liability). Once we receive your
DMCA Notification, we can proceed with the takedown.


If you are not familiar with the DMCA Notification process or copyright
law in general, I would highly recommend seeking the services of
intellectual law counsel. DMCA Notifications are pretty common/standard,
and it shouldn't be too difficult to get one drafted for you.


If you have any questions, please let us know."


So- basically, they want us all to get a lawyer to file official paperwork or whatever. I'm beyond pissed.

Ah, but we needn't all do that. All we need is one of us to work out the first format and post it. I'm sure that we can manage that - I'm looking about myself.

(ETA: Also found this - http://www.seologic.com/faq/dmca-notifications.php - a page of sample notification forms for the major search engines - but Zeb's method seems a good one if he'll let us use it, since we know it works.)
