Clumsy Rip-Off

I have already emailed the abuse department of the ISP provider, as well as called and left a lovely, lovely little message for them. They're about three hours behind me, so I'm actually feeling sorry for the poor bastard who checks messages when he comes in this morning. That won't stop me calling every other hour though. My main goal: in light of the site's BLATANT and EXTRAVAGANT theft, I want the whole site taken down. And I'm a stubborn bitch about it too... I'd recommend, in addition to emailing the abuse department, anyone who can call in and file a phone complaint against the site. They tend to work a whole lot faster when they've got a bug in their ear from multiple people.

Oh, and on the bright side: if the ISP doesn't fix it after they've been informed of it, they waive their "no responsibility for content" privileges, as they have just knowingly abetted an illegal act. So even if you can't get teh Chinese end of it in a legal vise, you can get the Californian one.

Cool. Some good news, then. Thanks, Falling.

As best I can tell they have only stolen stories up to the Gay Male cat but expect the rest to show up shortly...

They have all of my BDSM, Erotic Coupleing, E&V, and First time stories.... From browsing the list of stoies in each cat.... it looks like a wholesale lifting of Lit... first page of each story only.... they wipe the authors name and paste it in...

I'll PM laurel and then e-mail the ISP....

Here's the email you will get back from them....

If you are asking us to take action against the website in question
because you believe that it infringes your copyright, please send us
an official written notice that complies with all of the particulars
for written notice under the DMCA (Digital Millennium Copyright Act).

We will then respond appropriately after reviewing your notice. I'm
sorry we can't be of more immediate assistance to you.

Zeb-
Yeah, I did. And then I gopt on the phone.

The response I sent back to them... well, I didn't send it, this is why I cultivate legal sharks as friends... should get their asses in gear. :D I'm a nice person, usually, but you fuck with my work and I'll disembowel you in every conceivable fashion.

Thanks for letting me know, dearest one.
Shang,

Any chance you and some friends can just go eat their grass, and leave your massive droppings?

They have at least six of my stories. Fuckers. So pm Laurel and what else do we do??

You know. I'm a little pissed about this, the more I think about it.
And also- they were really stupid. They even stole Pleasing Ellie, a story actually in print via the Coming Together anthologies.

Shanglan and I are going to China to hogtie them and then go out to dinner. Care to join?

I vote we be traditional and engage in some Chinese water torture while we enjoy our pan-fried noodles.

Brilliant. I'll get the watering can.

I wonder if US copyright law has any applicability? They have one of mine and all of mine are copyrighted.

I doubt it. Even if it did, the Feds never push Beijing hard enough on intellectual property issues, if you ask me. It's part of their appeasement policy toward Red China.

I doubt that they care much about the rights of porn/erotica/smut writers. But it's worth a shot.

I didn't see any of mine there, but I didn't look very hard. Has anyone come across a story of mine while checking the site? I'd look myself, but I'm lazy. ;)

I thought the chinese were cracking down hard on internet porn. If the site is based in China, I wonder by what mechanism you could report them to their party comrades?

The food in China is not what you are used to here in the States. I was in Shenzen back in 2000, the food was marvalous but there was nothing on the menu's called pot stickers or chow mein. So don't expect to see what ever you enjoy in the states over there. :D

The ISP is in California, so it must comply with US law for site which reside on it's servers. A copyrighted peice doesn't need to have a copyright statement to have a copyright. If you wrote it, the copyright is yours until you die. Actuall 10 years after you die. So it is passed on to your heirs who can then extend the copyright another 15 years or so.

Hard to say. That might be an interesting. I hate to help censors, but these guys are plagiarists, not pornographers.

I sent a complaint to the "Abuse" email address listing at the ISP. I suggest that we all do. The more (civil, clear, and well-supported) complaints they get, the more clear it will be that the site is plagiarizing. If they don't act on it, then the volume of complaints may also help to convince them that the site is more trouble than it's worth.
