This is not about anyone else but me.
I'm concerned that a celebrity story idea I have (turning on screen personalities into erotic superheros) is copyright infringement.
I know about Laurel's fair use statement and link to a case, but isn't that just one instance?
Penthouse is a widely read magazine, mass produced in the millions, possibly billions.
Videos (now DVDs), calenders, and other merchandise have all taken off from this magazine.
While it's true Literotica has visitors from other counties (hence the foreign language forums), a "Best Of Literotica" Amazon book (with e-zine sequel), and I think an RSS feed, I still don't think it's up to Penthouse standards (although some of the stories could be featured if they had better spelling).
Do you remember the now X-lawyer Jack Thompson?
On the (??) anniversary of the penthouse ruling, a similar remark was written up by a gaming site (applied to the statements that EA is working with the porn industry and violent video games like GTA are murder simulators).
Free speech was what won the case, not fair use.
What I wanna do is much more than a small political cartoon in a small time gaming site.
I asked for permission (sort of) but didn't get an answer.
