well so much today seems to rest with suing a manufacturer or business when something goes wrong. people cry foul. they want a soulution. they decide to sue.

among the most notable are the lawsuits that have been filed against cigarette manufacturers.

so my question is should the manufacturers of any and all alcoholic beverages be held liable when deaths or crimes are committed when an individual is under the influence of alcohol.

it would seem only a matter of time before this happens.


my opinion is no....this would also apply to people who smoke, little old ladies who lack any manual dexterity and spill hot coffee in there lap while driving...a parent that sues a school becuase his or her daughter or son did not make the team.

i think we are beginning to live in an age where lawsuits have replaced common sence and people are now bieng rewarded for there own stupidity lack of common sense and inability to accept responsibility for there own actions!
 
Retailers can be held liable for the actions of intoxicated minors.

indeed they can but is the root of the problem the alcohol companies themselves...the stores or establishments that sell alcohol OR is it the individual who consumes the alcohol that is at fault?
 
Smoking kills or causes harm when used as directed. Alcohol does not.

Tobacco companies were susceptible to lawsuits due to fraud and non-disclosure. Alcohol has more than ten-thousand years of anecdotal evidence and 100 years of study that limits the likelihood that Seagrams, et al are hiding facts.
 
Nice thread christophe, I'd suggest a similar warning along the lines of.


**WARNING- the consumption of this product may diminish the capacity of logical reasoning. You may wake up with a sea-donkey or man-beast by your side. Enjoy responsibly, if you feel you cannot imbibe this product in keeping with your morals then take up a hobby and return this unopened to your retailer**

but what is "AS DIRECTED" thats the key word...some people can have one drink and become intoxicated very quickly...others can down a 12 pack and seem relativley sober....facts are facts they both can kill if abused...so to whom does the burden of responsiblity fall to the maker or the one who imbibes
 
I worked at a Walmart a few years back..


One night another associates husband came into the store, obviously flyin high. He went up to the counter to purchase some more beer, which is a strict no no.

If you can tell that someone has already been drinking you are not to sell it to them, at least in that state at that time. Those are just the rules.

The cashier did the proper thing and called her CSM ( pretty much the head cashier) over for her to handle it. The CSM then turned it over to the Asst. Night Manager on duty. She gave the okay to sell the alcohol, knowing the laws and the liabilities.

After giving it, she promptly walked over to the Customer Service desk, picked up the phone and called the local police - which was across the road.

The man left the store with his purchase, walked to his car, got in and just after he started to pull out, the police nabbed him.

This story isn't really all that relevent to your thread, but when reading it.. I recalled it.

double bagging not included...not responsible for damaged egos...idiotic behavior...morning hangovers or pissing yourself during the night

The discuccion was of health, not intoxication. Two very different issues.

The public is well informed of the risks of getting shitfaced all the time, or drinking moderately but all the time. The dangers of smoking were partially covered up, which is the foundation of the lawsuits.
