46 is currently on his second try and was blocked once..... Though the current policy is rolling out.

Write and pass new legislation is the answer. The problem is, one side doesn't want new legislation, because it will take away one election campaign issue from them.

You don’t recognize the reality of US politics on this issue. Neither side has succeeded in passing immigration legislation in nearly 40 years.

Schumer lost 5 members of his own majority in the latest Senate attempt. The belief that a bill negotiated in secret could get 60 yes votes in the Senate just days after its unveiling, with no active public promotion from the President is incredibly naive.

Trump used a number of actions to impede border crossings. Some were more successful than others, but immigration activists like the National Immigration Justice Center were outraged by the efficacy of those actions. Border encounters spiked when Biden took office. Construction of the wall was halted, the “asylum cooperative agreements” with Guatemala, El Salvador and Honduras were immediately terminated, and after two years of trying, Biden finally won court approval to end the stay in Mexico policy.

The court action 1174 is probably referring to involved Trump’s 2018 order to “suspend and limit” entries between the ports of entry (with some exceptions). People could still apply for asylum if they went to ports of entry. The rule was challenged, and a federal court in California granted a temporary restraining order and then a preliminary injunction. That injunction was upheld by the 9th Circuit. The Supreme Court declined to stay the order but SCOTUS never ruled on the merits. Trump lost reelection and the Biden administration WITHDREW Trump’s order. It’s common for justices to deny a stay of a rule while a case works its way through the courts and ultimately invalidating that rule. Legal experts cite compelling reasons to believe SCOTUS would invalidate that rule but no one can say with certainty because Biden pulled the plug.

Over the past couple of days, multiple news outlets including CNN, New York Times, Politico, NPR and others are reporting that Biden is now considering executive actions to stem the tide. It’s reported he’s looking at banning asylum requests between ports of entry and tightening credible fear criteria. Sound familiar?

If the courts have already shut down the president’s options for exercising executive authority, and if Biden has done all that he can do, it begs the question - why is the Administration suddenly now considering executive action?

I’ve said repeatedly that both parties have failed for nearly 40 years. You keep insisting it’s just Republicans but that is obviously not the case. The two parties are fundamentally divided on the issue.

Pointing out the history of attempts to pass immigration legislation isn’t complaining. It’s accepting reality. POTUS is reportedly considering using his executive authority to issue orders that are similar to Trump-era amnesty and parole policies (and provisions that are in HR2 and the Senate bill) to slow the influx. It’s ironic that I’m supportive of that and you seem to be arguing against it.

Yes, illegal immigration persists at extremely high levels compared to prior years. We should be shocked when huge numbers of people don’t show up at the border—which has only been achieved through economic downturns.

The answer to why these measures did not work is complicated in some ways, but the basic point is simple. When large numbers of immigrants do arrive, the government lacks the resources to detain and remove all of them. That’s why the Biden administration has asked for unprecedented resources to carry out its deportation agenda, effectively doubling Immigration and Customs Enforcement’s annual budget. But even this level of resources will be insufficient. Because the benefits of living and working in the US are so great, many immigrants will still find a way.
