Alan Dershowitz on Libby's Commutation

I'm sure he appreciated it.

I'm sure he did at the time. I just don't see his life as being a bed of roses these days.

Big difference here.
Clinton was aquitted.
Libby was convicted, 4 of 5 counts.

Tourettes kickin in again eh?
Clinton did it!Chappaquiddick!
*squawk!*

That whole cunard "they always bring up Clinton!!!" is getting old. Clinton inserted himself into this issue by making a public speech criticizing Bush. It's fair game to talk about HIS pardons.

Clinton was NOT aquitted. He cut a deal with the DA and judge. Basically he plead guilty without charges being formally presented. The judge then disbarred him.

Don't confuse the impeachment proceedings with what occured in the federal court of law. They are only marginally connected.

He was first disbarred by the state court. Disbarment by the Federal Courts was reciprocal.

You never know. He might have enjoyed prison.

Yup. Now that you bring it up it was an Ark. state court that disbarred him.

The right wing appologists were touting Clinton's pardons from the very first day. As usual using the "two wrongs make a right" rationale to justify Bush's commutation of Libby's sentence.

Clinton's speech came afterward, in response to the "Conservative Tourettes" attacks.

It's canard by the way..

No they didn't. Do you ever get tired of being wrong?

The Arkansas Supreme Court suspended Clinton's Arkansas law license in April 2000. On January 19, 2001, Clinton agreed to a five-year suspension and a $25,000 fine in order to avoid disbarment and to end the investigation of Independent Counsel Robert Ray (Starr's successor).

On October 1, 2001, Bill Clinton's U.S. Supreme Court law license was suspended, with 40 days to contest his disbarment. On November 9, 2001, the last day for Clinton to contest the disbarment, he opted to resign from the Supreme Court Bar, surrendering his license, rather than facing penalties related to disbarment.

His Arkansas state law license was suspended for 5 years, not revoked.

Clinton wasn't disbarred, it's a popular misconception, especially among the conservative crowd.
His state license was suspended for 5 years (The suspension ended January 2006) and he voluntarily surrendered his USSC license to avoid being disbarred.

Ahh........

Would you have ever thought in a 1000 years that he would stand up for Bush?
Good link.

And NO, I would never have thought he would stand up for Bush.

I give him credit.

I keep hearing that Libby's punishment was overly harsh and unwarranted, mostly from the same right wing boot-lickers.
The first time I've hard Dershowitz called a right-winger.

He has many unpopular opinions, but I didn't call him a "right winger". I did say "mostly from the right wing boot-lickers", not exclusively.

His opinion on this subject is completely off base, as is the that of the usual suspects here at Lit. The boot-licker comment referred to those staunch apologists bit here at lit and within the media at large.

Let me apply the Redneck Translator to UD...

If you differ from me, you're a Republican.

To "translate" for me you would actually have to read the entire post, in context, and comment from there rather than from a partial quote..

But you won't do that, preferring to snipe from the cover of ignore, ever the coward.

Yella-belly.

Right.

The Prosecution of Scooter Libby was about the law being broken, not political motivation. It was shown beyond reasonable doubt that Libby did indeed Obstruct a federal investigation, perjure himself before a grand jury, and give false statements to the FBI. The republican appointed federal judge cited "Overwhelming evidence" that Libby had done so.

Trying to paint the trial and conviction of "Scooter" Libby as some sort of "political conspiracy" involving the US Attorney, the Federal Judge AND the Grand Jury is laughable. Trying to defend the commutation of his jail sentence by citing Clinton's pardons is even more so. Last I checked two wrongs still don't make a right, but that's the argument being made here. "Clinton did it first!"

Defendants are often remanded to custody pending appeal, this is not an uncommon or an unnecessary verdict from the court as Bush and apologist boot-lickers insist. Especially in cases where a defendant can appeal the case in perpetuity.

This commutation wasn't about justice, it was about covering the President's and Vice President's asses and preventing Libby from becoming a witness for the Congressional investigation in return for a lighter sentence.

If you believe otherwise you're just deluding yourself.

So, the fact that Bush said Libby was guilty and should pay a penalty was wrong?

That aside, I think the only time a President or a Governor should commute a sentence or pardon a crime is when there is a gross miscarriage of justice. Moreover, I think we should pass a law that says a President can't commute a sentence for an official in his cabinet, or pardon someone in his cabinet, or the past sitting President or his cabinet. Let's see if the President and his admin team obey the law when they know they don't have a get out of jail card sitting in the Whitehouse.
Clinton was a pardoning fool. Even if they were clearly guilty.

Libby was not. But hey, thats politics right?

Speaking of boot-licking apologists... Right on cue, Rightfield and DT wade in to buttress Makersandice. Just a few more to go for the full set, Ishmael already made his Grand entrance and subsequently stepped on his own pee pee.

Libby was found guilty of four of five charges against him by a federal grand jury.

Trying to imply that he was not guilty of a crime shows exactly how out of touch you are with reality, and exactly how far you will go to hide from the truth.

Sucks to anyone actually interested in justice. The fact that you seem to be fine with it speaks volumes.
