1. Here in the Free State, our governor just signed a bill legalizing gay marriage.
2. In November, Minnesotans are going to vote on outlawing gay marriage.
3. The US Constitution says one state has to recognize the laws of the other states.
4. The Defense of Marriage Act says states don't have to recognize gay marriage of other states.

A. This is a very interesting Constitutional issue.
B. I don't care much about the religious/moral components.
C. I don't think the government should be involved in marriage at all.
D. Since they are though, Equal Protection would demand that DOMA is unconstitutional, and State laws prohibiting gay marriage should be void.

I. Now, if the government were not to confer benefits upon married people, the Constitutional crisis would be averted.
II. Backward States could continue to be scared of the homos.
III. The true conservative position is for the government to treat everyone as an individual and have no special treatment for married people.
IV. The current conservative ideology is 'social' conservatism - which is a lot like social Marxism.


These are my thoughts.
 
I think it's weird that there's a stipulation on the gender of who can enter into a legal contract.

Having said that, I dislike marriage in general. My grandparents have been together for 45 years, but there's no common law marriage in Ky, so my grandma gets none of his union shit, like she would if they were married. I honestly have no idea why they never went and got that goddamned paper.

The States have always enacted conflicted laws. Emancipation is one example: In Michigan 17 is the legal age of emancipation, in Florida the age is 18. If a freshly minted Michigan 'adult' comes to Florida her emancipated status means nuthin. An 18 year old New Yorker cant drink alcohol in Pennsylvania.

I know it's not the social issue of the thread, but this has ALWAYS pissed me off- I can vote, I can smoke, I can go off to die in some godforsaken blistering desert-

Well in Canada, same sex marriage has been legalized for several years, and you know what affect it has had on straight marriages? absolutely none whatsoever.

Ironically though, the divorce laws have not officially been updated to contemplate same-sex divorce. So Gay marriage in Canada is kind of like Hotel California - "you can show up anytime you like but you can never leave."
 
I seriously don't get why we need marriage laws at all. It's kind of crazy- it's a legal contract where you give someone else half your life. We already have child custody laws, we already have personal property laws, we already have joint property laws. Marriage is retarded.

And that's not because I have commitment issues, it's just that it causes way more harm then good. Most marriages last 4 years. My grandparent's relationship lasted 45. So far.

R's have been happy to let the word 'conservative' apply to any number of incompatible elements. Fiscal, social, religious, and legislative conservatives (i.e., Libertarians) have almost nothing in common except the use of that word.
