Take note that any appeal to the 11th Circuit will wind up in front of Justice Thomas who supervises the 11th Circuit and who wrote the concurring decision that contained the legal points on Jack Smith's appointment that Judge Cannon used to dismiss the case.

What’s destroying our country is the democrats incessant use of lawfare over the rule of law.
 
If it's reversed on appeal, the case will be remanded back to Cannon's courtroom. Smith can at that point take up the recusal motion but a reversal isn't a sufficient basis for recusal.

Obliviously she doesn't want the case.

Who said it did? We know how he would initially rule. Smith would still have the ability to request a full court hearing on the issue. The point is it would not be heard at the earliest until next year when the question will be moot.
 
It’s that bit from @butters post that people seem to have not taken into consideration.
I believe Smith is neither a US attorney nor federal prosecutor, he’s a U.S. citizen and doesn’t have under constitutional law the authority to prosecute federal cases, IMHO
 
Judge Canon has denied Biden the opportunity to dismiss the federal charges against Trump.

It almost certainly will be reversed by the 11th Circuit, and I doubt the Supreme Court will rule in favor of Judge Cannon's opinion, even if it grants the cert petition, which it may not. It may not matter, of course, if Trump is elected (as I think he probably will be) and shuts down the prosecution, as he is likely to do.

I don't trust ANY leader's judgment. In a decent, constitutional system, we limit the leader's power because we have to imagine someone whose views we hate assuming the powers we've given to the leader.

We've never seen anything quite like this before. Trump doesn't want to be limited or regulated by any laws, and his followers are just fine with that. It's the first time in American history that we have a presidential candidate as cult leader.
