Jonathan Turley Explains Why the Trump Verdict Is Ripe for Appeal

"However, in a maddeningly circular theory, that other crime could be the falsification of business records. It could also be violations of federal election and taxation laws, which Trump was never charged with, let alone convicted of."

“Judge Merchan allowed a torrent of immaterial and prejudicial evidence to be introduced into the trial by the prosecution. That included testimony from porn actress Stormy Daniels that went into details about having sex with Trump,” Turley writes. "She included a clear suggestion that Trump raped her. After this utterly disgraceful testimony, Merchan expressed regret but actually blamed the defense counsel, despite their prior objections to the testimony."

And finally, there’s the jury instructions. As Turley explains, despite numerous reversible errors a hung jury seemed possible, until Merchan gave his instructions to the jury—which seemed engineered to ensure a guilty verdict. The jury was permitted to conclude that the secondary offense could be any of three vaguely defined options without specifying which crime they found. Thus, the jury could have split 4-4-4 among conspiracy to conceal a federal election violation, falsification of business records, or taxation violations. This lack of clarity means Trump will never know the specific crime he was convicted of.

These points by Turley have merit for appeal. All however will be lost on the propagandized left.
The previous DA looked at his double booking methods, one false set for taxes at the time he became President. In that effort, given the election results and Trump becoming President, he decided not to pursue the business fraud matter. The DA's time in office was expiring, so he halted the process.

At that point, incoming DA Bragg picked up the ball and pursued the matter. He learned about Stormy and tied that to the previous fraudulent bookkeeping, then added the aspect of elevation to a third level. COVID caused cases to be extended by Governor's decree, which was lawfully done, so the expiration was extended, so Turley overlooks that fact.

Stormy explicitly stated in her testimony the sex was consensual. Rape was not a claim. Turley is wrong.

Turley's last claim has been covered numerous times, and it has been repeatedly pointed out that this was not true.

He is correct about the right to appeal.
 
More bad news for the hapless left. Four of the coordinated complaints filed in one week last month against Judge Cannon with the Federal 11th Circuit Court of Appeals have been thrown out as groundless.
Enjoy those trivial victories when you can. Fortunately, Cannon isn't in charge of all of the other, what... 49 felonies Trump is still facing, on top of the 34 he was just convicted on?

The number three attorney in the Biden DOJ went to NYC to supervise and advise Bragg's prosecution of Trump. Fanni Willis and Leticia James both met with White House officials. And we know that Merrick Garland at the behest of the Biden White House is guiding the corrupt Jack Smith in his phony prosecution as well. There is a House committee investigating and taking sworn testimony on this issue as we speak.
The House has taken testimony for millions of days on Joe Biden. What did it get them? Answer: nothing but egg on their Republican faces.

And which of these applies to Trump sitting in a jail cell would legally entitle him to order the National Guard to break him out of jail?
The key conditions under which a president might declare martial law include:

  2. Natural Disasters: In the aftermath of catastrophic natural events such as hurricanes, earthquakes, or floods, if the local government is unable to maintain order, the president might declare martial law to restore order and provide relief.
  3. Foreign Invasion or Attack: In the event of a direct foreign invasion or significant terrorist attack that overwhelms local and state capabilities, the president may declare martial law to ensure national security and maintain order.
  4. Rebellion or Coup: If there is a rebellion or an attempted coup against the government, martial law might be declared to suppress the threat and restore government control.
Of course, he must negotiate with Congress over the checks and balances matters. So, if he can convince Congress that one of the above four conditions is applicable, he might try.

Question for you. Would a military body honor his orders if they thought he didn't issue a lawful command?

It was a civil trial where proof beyond a reasonable doubt is not required and the jury went with guilty of sexual assault based on the preponderance of the bullshit. If this had been a rape case in criminal court it would have been thrown out due to lack of evidence or proof beyond a reasonable doubt. This judicial malfeasance isn't just about Trump, it's about venue, about having a fair trial. It's about officers of the court with a political agenda. The New York justice system has some real problems. What used to be the gold standard for juris prudence has now morphed into something right out of N Korea's penal system.

The same shit happened with Letitia James and that victimless fraud case at the hands of another overbearing activist judge and a biased prosecutor who campaigned on getting Trump.

While the jury could not conclude exactly what body part Trump forced into Ms Carroll's vagina (penetration), they did agree that it was, at minimum, his fingers. Which I'm pretty sure by definition are considered "body parts". So by your own definition, Trump was found liable for, say it with me, RAPE!

I imagine that eventually you'll claim that there are only FOUR venues in the country Trump could possibly be convicted in, FOUR places where he cannot possibly get a fair trial. Including Florida.

Yes. I am immune from retribution. And I absolutely don't have a problem with Trump being the first and only president to serve out his term in prison. It would be a huge inconvenience for him, but then again, he shouldn't have committed at least 34 crimes.

I find filing charges 20-25 years after the alleged crime was committed very suspicious. I read the transcript of the trial and under normal circumstances, pressing charges WITHIN a reasonable timeframe supported by a police report I would agree that Carroll had a compelling case for filing criminal charges, but that didn't happen.
This trial played on the emotions of the jury. Another ASA case allowing allegations (charges) that outran the statutes of limitations once again resurrect from the dead tried in a hostile NY venue. If Trump actually committed these crime I would totally agree throw his ass in prison. Just my opinion.
