I hope Congress can send Jungle Gym Jordan to jail next for ignoring his Congressional subpoena. I've lost track how long it's been since they issued it and he ignored it.

Seriously doubt he actually wrote that, he's not truly creative. When he gets pithy, his style is specific and meandering with thesaurus-laden ejaculations.

From what dark web sites are you getting these conspiracy theories? I mean, Joe Tacopina, trump’s former attorney even said it’s crazy and no way Biden has anything to do with a state case.
Just move away from CNN and MSNBC and you might run across the truth somewhere.

My answer is that I don't know. [Honest answer.]

Legally he isn't President until he's sworn in. However, after the election he is President elect, should he win the election. Once Biden's term ends on Jan 21st and Trump cannot be sworn in because he's being imprisoned and the prison won't allow anyone to perform a swearing in ceremony, what then? [He could be sworn in in prison. Nothing prevents a federal judge from visiting him and conducting the procedure in prison. Got a citation that says the jailers won't allow him to raise his hand, put the other on a Trump Bible, and swear to uphold the Constitution?]

Who is president after Jan 21, 2024 if Trump is elected but cannot be sworn in? On the surface one might say that the VP becomes President but that's not the way it works. The House cannot just "pick" someone if there is already a duly elected President. Nor can they follow the constitutional line of succession to place the speaker into the office of President. Why? Because there IS a President elect already who is eligible but is being prevented from taking the oath of office. It's not that he "cannot" assume the duties of the office of the President, it's that he's being "prevented" from doing so by a state actor. [Fabricated speculation.]

In a nutshell, one state has determined that Trump cannot be President even if he's elected. This violates the concept of federalism in which states cannot dictate the actions of the Federal government. [No it doesn't. The state found him guilty of business fraud rising to a higher crime of trying to hide facts that affected a state/federal election. The state prosecuted him for state law violations. It did not act to prevent him from being elected in the election.]

Basically all of that creates a Constitutional crisis in which the US has no President because the opposing and outgoing party is prohibiting the elected President from assuming office by imprisoning him and no replacement can lawfully be made. [Red Herring - baseless statement.]

If, however, the President elect assumes the mantle of commander in chief after Jan 21st by virtue of his being elected even without the oath being administered, then lawfully he could declare martial law and order the NG break him out of prison. [Untrue - there would be no foundation under which he could lawfully declare martial law.] Fortunately/unfortunately there's no precedent for this. [True.]

So the answer is; I don't know. [True.]

What I do know is that almost no one on the Left even considered this possibility or the consequences which naturally flow from it. Whether it comes to pass or not depends on whether the SCOTUS takes up the matter and decides if Trump's conviction/possible imprisonment is lawful or not. If it isn't then a lot of people who are currently jumping for joy are going to catch hell.

If it is lawful, then all of us are going to catch hell. [Untrue. All of us will go about our lives unless we are part of another J6-style event, and then, of course, we should expect to be in a cell, perhaps alongside Trump.] :nana:

I openly said I don't know the answer and posted my thoughts based on what I know about how the order of succession works.

What I know isn't complete, which is why I said I don't know. What I do know is that we have precedent on who becomes President if the President elect dies before assuming office. We have precedent on who can be on the ballot if the candidate dies before the election. We have precedent on who gets sworn into the office if the President dies while in office. We even have rules to determine the order of succession if both the President and VP become incapacitated or die during the presidency.

What we don't have is anything to tell us who is President if the President elect cannot be sworn in because he's being imprisoned somewhere. ANYONE who believes that is a simple question to answer is a doofus. Bloody and violent wars have been fought over who succeeds to the seat of power when this kind of shit has been tried in the past and YOU FUCKING MORONS think that putting Trump in jail is the answer to all your political aspirations?

Trust me, you haven't thought this through. At all.
