Monday, April 15th: First Ever Criminal Trial for a Former US President

I openly said I don't know the answer and posted my thoughts based on what I know about how the order of succession works.

What I know isn't complete, which is why I said I don't know. What I do know is that we have precedent on who becomes President if the President elect dies before assuming office. We have precedent on who can be on the ballot if the candidate dies before the election. We have precedent on who gets sworn into the office if the President dies while in office. We even have rules to determine the order of succession if both the President and VP become incapacitated or die during the presidency.

What we don't have is anything to tell us who is President if the President elect cannot be sworn in because he's being imprisoned somewhere. ANYONE who believes that is a simple question to answer is a doofus. Bloody and violent wars have been fought over who succeeds to the seat of power when this kind of shit has been tried in the past and YOU FUCKING MORONS think that putting Trump in jail is the answer to all your political aspirations?

Now I have a question for you:

IF Trump is elected in November, and he becomes Commander in Chief again, can he lawfully declare martial law and order the National Guard to break him out of prison in NY?
The key conditions under which a president might declare martial law include:
  1. Severe Domestic Unrest: This includes widespread riots, insurrections, or civil disturbances that local law enforcement and state authorities cannot control.
  2. Natural Disasters: In the aftermath of catastrophic natural events such as hurricanes, earthquakes, or floods, if the local government is unable to maintain order, the president might declare martial law to restore order and provide relief.
  3. Foreign Invasion or Attack: In the event of a direct foreign invasion or significant terrorist attack that overwhelms local and state capabilities, the president may declare martial law to ensure national security and maintain order.
  4. Rebellion or Coup: If there is a rebellion or an attempted coup against the government, martial law might be declared to suppress the threat and restore government control.
Of course, he must negotiate with Congress over the checks and balances matters. So, if he can convince Congress that one of the above four conditions is applicable, he might try.

Question for you. Would a military body honor his orders if they thought he didn't issue a lawful command?
 
Yes. I am immune from retribution. And I absolutely don't have a problem with Trump being the first and only president to serve out his term in prison. It would be a huge inconvenience for him, but then again, he shouldn't have committed at least 34 crimes.

The charges are phony and the legal theory behind the prosecution is novel fantasy and it was sold to a tainted jury of people who were not his peers but his enemies. Trump was entitled to an impartial jury and an impartial judge and due process of law. Not a conspiracy between the DOJ and Bragg and the media circus atmosphere surrounding the Trump case has poisoned the jury pool. The case Sheppard v. Maxwell, 384 U.S. 333 (1966) comes to mind:

"This federal habeas corpus application involves the question whether Sheppard was deprived of a fair trial in his state conviction for the second-degree murder of his wife because of the trial judge's failure to protect Sheppard sufficiently from the massive, pervasive and prejudicial publicity that attended his persecution... We have concluded that Sheppard did not receive a fair trial consistent with the Due Process Clause of the Fourteenth Amendment and, therefore, reverse the judgement."[1]

What's most disturbing about this case is that it doesn't relate to anything Trump did while in office, during his recent election campaign, or even during the tumultuous transition period four years ago. Instead, it focuses on events from nearly a decade ago, specifically regarding the alleged cover-up of a crime that other prosecutors chose not to pursue against the former president. If this is the new standard, Democrats will rue the day they ever embraced it.

Old Shitzenpants will have the ability to appeal the verdict, just as the rest of us normal citizens do. Since before 2016 all of these investigations, impeachments, and criminal trials are politically driven to deprive the people of the United States of their right to choose who they want to be President of the United States.
