Monday, April 15th: First Ever Criminal Trial for a Former US President

You laugh but you don't know what you're laughing about. Your comment has no relationship to what is being alleged by Professor Dershowitz.

That may be, yet it is the same incidence of criminal activity. Saying Bragg was shopping for a crime is bullshit, Trump and his businesses have been committing crimes for decades. It’s a prosecutor’s duty to identify what crimes were committed, what statutes apply, and which have the best chance of attaining a conviction.

Just because Trump has tried to label reports about his alleged criminal activity “fake news” doesn’t mean everyone has to believe him. Refusing to pay contractors or pressing them until they agree to take dimes on the dollar may be legal but it’s dirty business and speaks to his character. You may be a duped true believer but most reasonable people know he’s crooked, especially in business. He was also crooked in his campaign and that has now been proven in a court of law.

You’re absolutely correct, we have a crisis of governance and it stems from the White House.

No you hysteric traitor. It's the conservatives who have been throwing ape shit fits since before Bill got sucked off in the oval office.

Biden's just about as no drama as it gets.

You have the self awareness of a turnip. And the honesty of a crook.

I am so goddamned tired of hysteria taking the place of governance.

It’s all part of the corporate long game to eliminate government oversight and regulation:

Corporations fund lobbying for divisive laws that sow chaos in government, which sows chaos in the streets, which sows more chaos in government.

And while decent, intelligent, sane politicians and citizens are occupied / distracted with / by the chaos, and defending against the divisive laws and the zealous (insane) public proponents of those divisive laws, the corporations exploit workers and the environment to enrich themselves.

Of course, the primary / ultimate goal still is to destroy the government and its ability to conduct oversight and enforce regulations. (See: The attempts by the right wing political shills for corporations who are determined to gut the IRS of funding to audit the super rich and corporations.)

"Small government" = "Little oversight" / "Little regulation"

🤬

JFC

SAD!!!

Like I said “LOOK IN YOUR OWN BACK YARD “

There are so many points of contention with this case. Merchan was basically acting as a one man steering committee.

What is so surprising is how the information given by the DA to the grand jury was incomplete. Exculpatory evidence that was available from Costello's testimony was not included in the indictment. We all know why that evidence was left out. I'm not sure if the Brady rule extends to grand jury testimony but the fact that exculpatory evidence volunteered by Costello during a grand jury hearing was with-held had influenced the prosecution's rapid objections during Costello's cross examination by the defense.

The second point of contention was the fact that Bragg used Cohen as the primary witness for the prosecution perhaps knowing full well that in order for Cohen to support the indictment during questioning Cohen would have to perjure himself and hopefully not get caught. That subornation of perjury will, if charged at a later date, fall right in Bragg's lap. He could be charged with a felony.

Merchan put his own personal political interest ahead of justice. The inconsistencies displayed by Merchan during the trial are so numerous it's a waste of time to list them.

On to the appeals.
Some much armchair quarterbacking in these statements. One would think this was actually going to play out in real life, but then it's from a Lit commenter using a fantasy playbook.
  • Care to speculate on the exculpatory evidence?
  • We all know why the evidence was left out – snarky, and no, WE all don't.
  • The second point is speculation, not fact
  • You have no basis for saying Merchan put his personal interest ahead of justice. Speculation again.
  • Smirk about so many inconsistencies that you can't cite any of them.
Yep, on to the appeals; Trump was found guilty, which is out of the way. Let's see if he can convince the ladies at the next court level that he is innocent. And, please, don't start commenting about those four black lady judges being prejudiced toward a landlord who refused to rent property to Blacks.

Dershowitz: It’s a Day After the Ruling and I Still Don’t Know What the Crime Is – Merchan Took This a Step Further than Stalin – Supreme Court Should See This Case and Reverse This Case
By Jim Hoft Jun. 1, 2024 10:40 am

Alan Dershowitz: I want to say right now, I side with President Trump’s assessment of the judicial system more than President Biden’s assessment. I’m a liberal Democrat. I voted for Biden. Biden is dead wrong. We should not respect the legal system that is rigged. In my book, Get Trump, I predicted months before this case ever came to trial that it was a foregone conclusion there’d be a conviction. A biased judge, a biased jury, a biased prosecutor, a man who ran for office on the theory of, let’s find a crime to prosecute Trump for, and they couldn’t find the crime, so they made it up.

We’re now a day after the verdict. I’ve known criminal law. I’ve been involved in criminal law for 60 years. I still don’t know what the crime is. Was he found guilty of intending to violate tax laws, to violate the federal election laws, to defraud voters? I still don’t know. And we’re a day after this. This is the most outrageous case. Everybody knows the quote from Lavrentiy Beria, the head of the KGB under Stalin, when Beria said to Stalin, “Show me the man and I’ll find you the crime.”

He tried to find the crime, and he couldn’t. So he made up the crime. He took it a step further than Stalin and Lavrentiy Beria.
This case will go down in history as one of the most abusive prosecutions since the trial of Aaron Burr back in ’18, whatever. This is a stain on our criminal justice system.

Alan Dershowitz: “Again, he was convicted of things that weren’t crimes… I think there’s a way of expediting the appeal, skipping the appellate division, going right to the Court of Appeals, ask for an expedited appeal with a decision within a month, and then take it to the Supreme Court. The Supreme Court should take this case, should reverse the conviction, and let the voters decide who should be president without the thumb of an illegal prosecution on the scales of the election.”

Dershowitz expects the SCOTUS to overturn the case. As do many leading legal scholars and lawyers.
Sadly, Dershowitz has long followed Rudy Giuliani down the uber partisan and, for him, unintentional old man shouting at clouds trail though continues to issue screeds in attempts to be relevant.

The statute of limitations had been extended for two reasons: Trump was out of state for the duration, and Governor Cuomo had extended it during Covid.✅

The language of the law cited in the indictment for falsifying of business records includes the condition that elevates it to a felony, it was included in the indictment. ✅

Ҥ 175.10 Falsifying business records in the first degree.

A person is guilty of falsifying business records in the first degree
when he commits the crime of falsifying business records in the second
degree, and when his intent to defraud includes an intent to commit
another crime or to aid or conceal the commission thereof.

Falsifying business records in the first degree is a class E felony.”

So counselor, serious question for you:

Since this is a NY state conviction, what steps does the appeal need to go through before it is elevated to the Federal Supreme Court?

You know the answer to that question already so you're not really asking anything you're just posting words like you think you're making a point.

Here's the part you don't get, SCOTUS will eventually hear this matter. That there are intermediate appellate steps between now and then doesn't change that reality.

Now I have a question for you:

IF Trump is elected in November, and he becomes Commander in Chief again, can he lawfully declare martial law and order the National Guard to break him out of prison in NY?

it was a given... he's trying to reinvent himself as the new Mandela since there are still a few republicans who cannot accept his previous 'new Jesus' stance

Maybe, just MAYBE, you dipshits shouldn't have helped him do that by convicting him in a kangaroo court.

Jebus you people are fucking stupid. First you hate the guy merely because of politics and start to believe your BS claim that he's evil. Then you engage in election shenanigans which allows the guy to say you're nothing but cheats and liars. THEN you convict him before the eyes of the world on bullshit misdemeanors in what appears to be a kangaroo court. And now you're crying crocodile tears because he's turning in Mandela II?

Fucking dipshits the whole lot of you. You assholes are your own worst enemies.

The answer to your question is that dictators can do whatever they want when they have brainwash followers like you.
