Think of all the things Biden could do with immunity. It would be quite a stretch for Alito and Thomas to convince the rest of the Supreme Court justices that only Republican Presidents would have this immunity.

I think this is a dead issue. The Appeals Court stated the obvious. If Roberts has any sense of his historical legacy, he will not get SCOTUS involved.
 
I expect a 7-2 vote. I believe Roberts may, may, try to convince everyone that SCOTUS needs to show a definitive 9-0 decision but Alito & Thomas just have no more F’s to give and are too far gone. They answer to no one - not Roberts, not the Senate, and certainly not the American people. A dissenting vote by them is to their own benefit, signaling to the interests willing to line their pockets that they can and will find a justification to twist themselves for those interests. In a functioning court, it actually should be 8-0 with a Thomas recusal. In my utopia, the vote would 5-0 - counting Thomas and the 3 trump appointees also recusing.

It's not Roberts decision to make. That said, I doubt SCOTUS will take his appeal. The circuit court's opinion was comprehensive.
 
trump was arguing that a president cannot be held legally liable for anything 'criminal' he does not only DURING their presidency but also afterwards...for life.

that cannot float.

as for his words saying a president MUST have such immunity or else 'every president will be charged as a criminal' as soon as they leave office by 'the other side' sounds like his notion of a threat/plan for his senate/h.o.r buddies to act upon.
 
It's not Roberts decision to make.
Roberts ran interference for Thomas's ethical violations. He does have influence.

Trump's legal assertion is absurd. Not taking the case will give the justices a way out of that absurdity.

I have less faith in the Supreme Court than y’all. They’ve already demonstrated that they’re willing to make rulings with little to no legal foundation.

My prediction is they’ll give Trump anything he wants.
I think they'll fall on the side of not being able to conclude he's been involved in an insurrection (which, of course he has) without due process. That at least is an arguable position.

They've ruled against him several times before--and quite likely are to do so in the immunity issue--so it isn't really giving Trump anything he wants.
 
Read the full ruling linked in the other thead. They sorta kinda lay the foundation that he did.
 
What did he need immunity from? I thought he did nothing wrong.?
 
The trial is not going to happen in March. Summer at the absolute earliest but even that timeframe looks doubtful.

Do you seriously think there will be a trial in March? If not, when do you think a trial will begin?
 
So we have until Feb 12 for 45 to submit application for a stay to the DC ruling.

Without a stay, the case will move ahead. Even while SCOTUS considers any appeal.
