Federal Judges Drop Massive 261-Page Ruling Tearing Apart Conceal Carry Laws​

A three-judge panel has blocked major parts of New York state’s anti-gun law while allowing the state to create “sensitive sites” that limit where legal gun owners can carry.

However, the panel’s 261-page decision gave its thumbs-down to the state’s attempt to bar gun owners from carrying guns into churches, synagogues and other places of worship.

The ruling noted that its decision is not likely to be the last word as litigation continues that could include appeals to the U.S. Supreme Court. The ruling notes that it was focused on a request by Gun Owners of America and other plaintiffs for a preliminary injunction to block the law, not a review of the law itself.

The law required that anyone seeking a handgun permit appear for an interview with an official to ensure that they are of good moral character. The appeals court said the requirement “is not facially unconstitutional. A reasoned denial of a carry license to a person who, if armed, would pose a danger to themselves, others, or to the public is consistent with the well-recognized historical tradition of preventing dangerous individuals from possessing weapons.”

Some of what they left intact will no doubt be reversed in the SCOTUS. I recommend reading the entire decision as it is too long to summerize here. There is some good and some bad. Some of the restrictions the panel left intact will be reversed if appealed to the SCOTUS as they are not in compliance with existing Supreme Court jurisprudence.

There's a lot of "bad" in that decision and not much "good." More interest balancing at work despite SCOTUS saying that lower courts can't do that. then there's the lower courts doing the "Bruen 2 step" when Bruen was very very VERY clear that 2 steps is one step too far.

The Bruen standard is whether the infringement is covered by the plain text of the Amendment. Period! If it is, the regulation is unconstitutional unless the State can prove an analog from the time period of either the founding or enacting the 14th Amendment. One step.

The big news is twofold. 1. Whether the SCOTUS will grant cert for Nichols v. Newsom. It's unlikely but there's a possibility that they'll do a GVR because the case has been almost constantly held since 2009 and was decided under the old pre-Bruen standard. The appellate panel should have remanded it back for review under the new standard but didn't. Instead it affirmed the decision.

2. Is whether ACB will grant a stay in the Illinois assault weapons case or not. The state filed it's requested response to the interlocutory request on Wednesday. As expected, more interest balancing and some kind of reversed psychosis where supporting a new infringement abrogating an existing right is somehow status quo when the reality is the status quo would be to allow the continued exercise of the pre-existing right until the matter is fully litigated. It's a completely whacko brief and many are hoping that the court steps in.

I could save time and buy a replacement instead of looking for it.


Of course, I can't remember the last time I needed it.
