I'm working on my very first story. At this point it's a vanity project I've sworn to finish. I wanted to submit it here for critique, but I can't. It violates rule number one. Many of the intimate scenes are between 17 year olds. Each chapter comes with a disclaimer, that the activity takes place outside the US, and sex between consenting 17 year olds, or 17 year olds and older individuals, are perfectly legal. The disclaimer is the only part that is non-fiction. I know this from having lived there, and researched it to be on the safe side.

It was suggested that instead of 17 year old high school students, I make them older college students, but too many things would change, and it would be a completely different story. While erotica, there are several non-erotic themes, and the erotic scenes mirror real life; awkward loss of virginity, for example.

So, question is, what can I possibly do with this story? Do I have any hope of publishing this at all, or is it always considered child porn, even though the sex depicted is legal in the jurisdiction where it takes place?

You're right that it can't be posted to this site. Find a site where it can be posted. They exist. Check around.

Up age them a year and make them 18.

Lit's age policy has nothing to do with the law, it's a site policy. You either comply with it or take your story elsewhere.

It's not hard to comply - you just need to loose the idea "it's a true story" and say it's fiction, suddenly happening as if by magic on your eighteenth birthday.

I have a true "first time" story here - in real life I was seventeen, in the Lit version I'm eighteen. It's still the same story.

I honestly can't see why it can't just be 18. If you were intentionally trying to write an underage story where a young age was the factor that's one thing.

But you're literally trying to skirt this sites policy by one year for no reason that's apparent.

It's just as tiresome seeing everyone say the other sites are so much better as it is people coming in and saying their loss of virginity story is unique and precious and such a real experience it can never be changed. Oh my god I was seventeen. So what? We all lost our virginity, which is all these stories are really about. Why the big deal about age?

Unless, of course, you're skirting around a very young age, which from an adult is just a little bit dodgy. Some folk protest just a little too much, sometimes.

I didn't say that the other sites were better, just different. One of them is actually stricter than Lit on certain issues. They all have various quirks, good and bad.

Yes, I know seventeen versus eighteen is nitpicking. Maybe that's the point; I want to do the nitpicking, not them. The OP can make up his own mind, but when I started here I didn't even know there were other options.

Yep, just different submissions criteria and thus more receptive to some aspects not welcomed here. On the age issue, one of the other sites has a "minimum 14" acceptance rule.

If you just have to have your story have a high school venue rather than a community college or junior college, where the setting can be just about the same as high school, you really do have using the underage (here) card in your mind, I think--and are trying, at least subconsciously, to fluff the 18-years-old cutoff and play to the underage reader set. Most of the high school setting is younger than 18. The almost identical community or junior college settings separate out that age question.

It's still sixteen; I just put a couple of such stories there. I'm not sure what state and country law is, but Dolores in Lolita was only twelve at the start. It was published in 1955 in Paris. Much later a woman wrote a book called Reading Lolita in Tehran, and it seems (I haven't researched it yet) that the book was banned in Iran.
