I agree. There are first amendment protections here, however they do not include “imminent threat”. The Union did not passively allow the southern states to walk away and start their own government, just because some states were throwing a Trump-style tantrum. As a result of the Civil War, the Union was reaffirmed as being indivisible.

The legitimacy of secession was successfully challenged by the Union, and the southern states were not allowed to overthrow the sovereignty of the Union.
