More on the Flynn case

If he's found guilty of severe ethics violations, he will be required to sit on the sidelines pending an inquiry into whether he should be removed or not. IF the outcome is that he should be removed, the removal will be faster and easier without political ideology interfering due to the ethics violations and inquiry. It'll be almost pro forma at that point.

He's in some deep shit. All that remains is to find out how serious the Appellate Court is about enforcing the rules. That he decided to hire outside counsel tells the court that he's stubborn and isn't going to obey them if he doesn't feel like it. That's a very bad thing to do.

Okay, but would the Circuit Court allow those charges to hang over the head of General Flynn for the weeks or months this fiasco might require for resolution? Seems to me they ought to vacate the charges, now that there is no case or controversy.

I don't think so.

I think he's deep into the progressive mindset and inevitable mental corruption that being a criminal trial judge brings with the job. Facts and laws have stopped meaning anything to him. He has blatantly and openly become the poster child for the idea that the courts aren't neutral and instead rule based on pre-formed judgements and personal opinions regardless of whether there are facts to support those rulings or not.

The problem here is the question of how many times in the past has Sullivan done the same thing to other defendants? How many innocent people are in prison because he "felt" that they should be convicted?

ALL of those prior decisions will have to be re-weighed and examined and ANY irregularities will HAVE to result in the defendant(s) being set free even if they were actually guilty.

It's that unknown factor which makes what Sullivan is doing so pernicious. Courtrooms aren't about "justice" they are about "law". People have to trust that the judges in those courtrooms will faithfully apply the "law" and disregard everything else. When people lose that faith, there is no "law" AND there is no "justice" except at the hands of the mob.

He was reading media reports and believed them, ignoring the actual evidence presented in his court which is the only evidence he's allowed to consider.

Once he planted his feet by calling Flynn treasonous based on FakeSpyPilot type Russian collusion nonsense he was stuck. His pride won't let him accept the fact that he had no idea what he was talking about. Flynn wasn't even accused of any such thing. Now he's still refuses to admit he was wrong, so this has to be about something even though it was never about anything.

The Appeals Court is asking Sullivan to explain himself. He has until June 1st to do so. At that point, the Appeals Court must make a decision within 21 days (I think) of the filing.

We will find out on Tuesday/Wednesday if the Court is going to allow outside counsel. I am hoping they won't.

Judges are responsible for having a rational basis for their decisions at the time those decisions are made. Allowing outside counsel to craft an explanation for them after the fact goes against that idea.

Can you imagine allowing a judge to make a decision on something nationally important, such as an immigration ban, and having the judge's personal lawyer write the decision FOR him and then sign it themselves? It raises the specter of not knowing who is actually in charge and making the decisions. The judiciary isn't a puppet stage and judges aren't puppets. Further, there are rules against creating situations where there's an appearance of impropriety.

That's APPEARANCE of impropriety, not actual impropriety. Having outside counsel draft and sign your opinions and supporting briefs for your decisions makes it appear that you have no basis for those decisions and that someone else is directing your conduct in the courtroom.

Not true Con. He's a DC insider and all those folks do is gossip and plot. Sullivan has no personal vendetta against Flynn, he has no reason to in spite of his outlandish utterances.

No, there is a group in DC, a group that Sullivan is part of, that sees Flynn as a mortal enemy who must be destroyed at all costs. That is how Flynn ended up in the position he's in to begin with.
 
The sad news is, we are no longer a united people. On one side we have Americans, on the other we have those who want to be Americans in a country vastly different than the one we've lived in. The only way we're going to keep our country and our American values is to defeat these people on every level. We now know what it will look like if we don't.
