More on the Flynn case

WHEN the full US court of appeals overrules Judge Rao and Judge Henderson's partisan decision, it WILL be quite clear that they are biased and unfit to serve on the bench.

WHEN Judge Sullivan holds a hearing to determine the veracity of Bill Barr's justification for dropping the Flynn case, Bill Barr will be further exposed as a biased Trump crony who is incapable of administering justice fairly and is unfit to be the US attorney general.

The familiar pattern of corruption with everything involving Trump and the GOP is being put on public display......again.

Judge Sullivan has no such authority to overrule the decision to drop charges on Flynn.

Understand, nothing like this has ever been before a court before, No Judge has ever asserted what Sullivan has asserted in the judicial history of the United States, ever. What the decision shows is a politicized court with 8 Democrats and three Republicans, one Republican recused. The majority opinion is a simple grab for additional unconstitutional Judicial authority.
 
The United States Court of Appeals just ruled 8-2 that Judge Sullivan does, in fact, have that exact authority that you claimed he did not. They overruled a district judge who ruled otherwise.

Logical and accurate!

All you have to do is read the text, the appellate court shirked its duty and by not ruling allowed Sullivan to practice judicial activism and imho demonstrated the lack of courage and failure to follow precedence.

Small observation:

Judge Reo one of the 2 in the 8-2 ruling, has in the past served on the same bench as Brett Kavanaugh. On two judgements at least she has opined that Kavanaugh's opinion was too liberal. ;)
