That's what the judge thought too (the same judge facing it now). At the original sentencing, he asked the prosecution if they didn't think that maybe they should be charging Flynn for treason and he asked Flynn if maybe he should become more helpful to filling out the extent of the guilt of others before he sentenced Flynn to give Flynn a chance at a lighter sentence. Since then Flynn has become less and less helpful.

Not at all a patriotic American, no.

I read that Judge Sullivan, does not have to abide by the AG's dictum and may pronounce sentence as he feels fit teh crime of which he plead guilty. I presume he has the latitude to propose , rather that the months that the DOJ asked for in the original sentencing hearings at sentence of twice the maximum, once for each count.

It seems the Judge must also agree to drop the case after a conviction.
