Education secretary Betsy DeVos has introduced a new rule that could make it harder for child abuse victims to come forward at school.

The Trump admin introduced changes to Title IX to be rolled out this month about how sexual assault and harassment chargers are handled at K-12 schools and on college campuses.

Alterations to Title IX still state the survivor will be taken seriously, according to Ms DeVos, but that the accused cannot be presumed guilty.

No, I won't shut the fuck up. If someone is guilty of a crime because the evidence backs that up, then I'm totally cool with that. But the idea of having a biased hearing because of the SJW ideology that an accuser should be automatically believed is fucking ridiculous.

There was a story I read about awhile back. Two college students meet at a bar, get drunk and end up going back to the dorm room to fuck. Even though it was consensual sex, the guy assumed that she would accuse him of sexual assault due to the fact that she was too intoxicated to consent. Since he was equally intoxicated the previous night, he went and accused her of sexual assault first since he could also not consent due to intoxication. Under title 9, since he reported "the crime" first, she got railroaded in a collegiate kangaroo court. Title 9 has been broken and abused for years.

Proving your case in an unbiased court with actual evidence is not a radical statement. The idea that you do should scare the hell out of people. You're the 21st century equivalent of a Nazi Brownshirt. You either walk in lockstep with what I believe or I'll have you sent to the camps.

so she not only wants to remove 360M from the schools' budgets over 10 years but there's no guarantee the new mandates will be funded; she is removing the standard whereby reps of the victims' can question the accused in a hearing (saying it's allowed but not compulsory), but the victims have to fill out specific statements which are to be handed to select staff members--which may stop some coming forward if it's a teacher who has been abusing them! she's rewording the whole thing:

Another change Ms DeVos made to Title IX alters how sexual assault and harassment is defined in the law to provide protection for the victim. Currently, the rule states its "unwelcome conduct of a sexual nature".

Ms DeVos is now advocating for the phrasing to state a need for quid pro quo services between the perpetrator and the victim that are "so severe, pervasive and objectively offensive that it effectively deprives a person of equal access to educational programmes or activities." If this change is made, it would discount sexual misconduct and allow for sexual acts to happen that do not drive the victim out of their school or off campus.

Critics say Ms DeVos is not reforming the laws; she is instead rolling back the strides made by organisations to help victims report and handle abuse on a federal level.


no-one's suggesting (i'd hope) that all parties are not treated with equal fairness within the school system until facts are established and charges filed/abandoned/innocence or guilt evaluated. let's not forget that most children will be wary about coming forward against abusive adults simply because they feel they'll not be believed... their word against someone who might have taught at their school for years and who seems to be something very different from who they are.

Sexual assault cases should be tried in a courtroom, not a school. There are way too many horror stories about the accused not being allowed to adequately defend themselves in these school hearings. Even when he/or she had physical evidence and corroborating witnesses proving their innocence. At least in a courtroom, there are checks and balances. If the accused is proven guilty in that setting, then lock them up.

You might best ask what I think of your cheap shot. I didn't read the article. I responded to what you posted. Presumed innocence is a foundation of U.S. law. Then you collect the evidence with an open mind.
