Our government stopped paying my dad his pension and when I queried it they wouldn’t talk to me so had to arrange a home visit where I could support him. He was 90 at the time and wasn’t able to answer his front door as he couldn’t walk more than a few paces.

Turns out they posted a form to him that needed a signature at the door to prove he received it. Well as he couldn’t get to the door it was returned and they assumed he was dead. They did pay him all monies owed in one lump sum and amended his details so that I could represent him.

I did actually weigh them last year on a digital kitchen scale. but first I calculated they would be roughly 5.5lbs each (based on volume), however weighing I found 6 and a half pounds (and right side a little heavier than the left), so combined an extra 13lbs of weight

thanks, I dealt with a dead person once. My company often runs credit checks on anyone we might do anything with. I had never seen an issue with a credit check, so I assume standards are low. Well, one bounced back with no information, just a giant red flag. So I call, and they tell me the woman is dead. I verify the social with equifax, have copies of her documents, and while she was kind of up there in years, for sure was not dead. Anyway I had to tell her I couldn't work with her because she was dead, and yeah I know, I know, but you have some stuff to figure out. She came back months later, it was kind of a nightmare, but she got it fixed. Apparently, when she notified social security of his death, they killed her in their computer system instead, so eventually it was reported to the credit agencies. the next check did pass.

I know a couple people who have been in prison, but I know more people who have been in jail. Prison is longer term felony convictions, run by the state or federal government. Jail is short term misdemeanors, people awaiting trial, people servings less than a year. They are run by local law enforcement.

Really, that is why the USA probably has the highest incarceration rates. those stats include our jails, which in most other counties, one isn't given jail time for misdemeanors. Plus, they also include juvenile detention centers, immigration detention centers, and mental health commitments. Again, in many other countries these people would not be detained. Jails and detention centers account for almost half of that incarceration rate you see. and of those in prison for long sentences, half of them are non violent. our justice system here is incredibly punitive compared to other similar countries.

Even better, half of those who have been incarcerated for non violent offenses are for simple drug possession. So yes 9% of men in this country have been incarcerated at some point. You walk into a room and see 10 men, odds are one has. If they are black men, cut that in half, you only need to enter a room with 5. They probably wouldn't have been locked up in the UK.

father in law was in for taking a plea on a dui (pulled over was visibly intoxicated, failed a breathalizer)

most screwed up one out of my friends. College years, young male bought 10 ecstasy pills. common party pill for the age. well the sellers, had already been caught and flipped for police thus continued selling and recording the sales. of course, they are just silly college kids too, they don't know any big fish. police continue trying to run them for years, get no where. well statute of limitations is 5 years, so 5 years later police cut their losses and charge everyone they have. So the 22 year old college kid, is now a 27 year old upstanding man with a wife, a company, a baby, gets arrested for possession of 10 pills 5 years prior. Any possession is a felony with up to 5 years in prison. And starting to get into a double digit of any pill is dangerous here in my state. 25 pain pills for example, minimum 3 years, maximum 15 years, because even if it is yours, it is considered trafficking.

anyway, he took a plea, rather than face a possible 5 years in prison, he took 6 months in jail, to be server Friday nights through Sunday nights, so he could continue to work and support his family. Took him like 2 years serving weekends to serve the 6 months.

Don't we all feel safer that he was locked up behind bars every weekend?

that is america's war on drugs. isn't it obvious we are all winning.

I live here, it is hard to not know the law of the place you live.

Well men for sure have a harder time than women as far as conviction and plea offers. Race does play a huge part as well, even if we say it doesn't. Also finances play a big part. However most standard employers do tend to overlook misdemeanors. obviously depends on the employer and the crime, theft is more likely to be considered more heavily then say trespass. usually if asked if you have a conviction, next question is misdemeanor or felony. some just ask if you have a felony conviction and don't care at all about misdemeanor. Hence why most guilty people will plea down when offered. It is probably viewed as someone who has received a caution in the UK. I think employers in the UK can get those records. But I think cautions in the UK are more likely to be light punishment like do nothing but add the caution to their record, some community service, treatment placement, repaying or fixing damage. And it is police who make the offer of a caution if you admit guilt, versus a prosecutor. And while we tend to be more punitive with our low level offenses than the UK, I suspect it is looked at the same way to others

How much does a caution matter? How many cautions are issued? if those cautions were short term jail incarcerations instead, would the current incarceration rate double?

ah that urban redneck internet user dialect that I possess is a tricky one lol. I will say I recall being taught very little about the UK in our educational institutions and most was on England. I have some university education, but school of life is a much better teacher. My familiarity with English law is not strong, what I do know is correlated in my mind to American counterparts. Bobby means police office, solicitor is more like a paralegal, barrister is more like a trial attorney, magistrate is a judge, court officials wear wigs for no reason that makes sense to me, but judges don't get a gavel. Obviously, I am oversimplifying it to bring it to a level that makes sense to the way my world works.

biggest difference, the laws of England are the laws of England, and people are held to the laws of England. The laws of London are not vastly different from the laws of Manchester. Yes, the United States has laws, but the majority of criminal law has little to do with United States law. Each state makes their own laws, so what is not a crime where you are standing here, may be felony if you drive 50 miles east, or a misdemeanor if you drive 50 miles south.

this can be demonstrated in it's most extreme by say a man serving 10 years in prison for using medical marijuana. one state he committed no crime, another he committed a misdemeanor possession crime, and another he is a major drug trafficker. All depends which state he his standing in the moment he is caught.

or demonstrated by a 15 year old high school sophomore and 17 high school senior are in a relationship for a year. he turns 18 two months before she turns 16. In one state, that is ok, in another it is a misdemeanor and if there is any time, it will be short and in a jail. and in another it is significant time in prison, and a registered sex offender for life.

a man, who committed a burglary at 18, served 5 years, and at 30 is in possession of drugs, serves 2 years. then 10 years later he steals a slice of pizza. One state misdemeanor, small amount of time. Another, he will die in prison. Yes we actually have people serving life for stealing food, socks, toddler shoes, attempting to steal a radio, improperly filled out paperwork etc, as they had prior offenses, in some cases 20 years prior.

I am in Florida, so if one read American news, we are famous for our strict drug laws with charging low amount of personal use as trafficking as we set the threshold so low. We are also famous for our very broad laws relating to self defense, no duty to retreat, and castle doctrine. So yeah, shoot a an unarmed person you started an altercation with, you walk, but a 60 year old person short on cash, decides to sell their month supply of lorcet pills, picks an informant trying to get out of their own sentence as the buyer, they will probably die in prison, as they wont have someone to flip on as not a real drug deal or trafficker. Though in Florida's defense, we did eventually see the error of our ways, and have lessened the punishment on the not real traffickers, but that doesn't help all the thousands already serving 25 to life.

anyway, that is what I think is the biggest difference in the legal system, the fact they differ so much in one country separated by imaginary lines that may or may not have a sign on the road. ok and the weird wigs lol

yes and no. many states have a limit on of far back an employer can look, so while it is still there for police to see, an employer can't see it. Also, many people who are given a pardon (clemency) will not qualify for expungement or sealment, and many people who qualify for expungement would have never qualified for clemency. These are all related to state laws, vary greatly from state to state, and are two very different processes

Personally, I only know one person who has gone through expungement of a criminal conviction of an adult crime. Juveniles in most places, it is fairly easy, unless the crime is on the Nope list in that area The adult I know, is actually that 18 year old senior earlier. He is now a 40 year old man, with a wife (who gasp is 4 years younger), and kids, whom he could not go to school to pick up if they were sick or attend an event, as yeah, registered sex offender. I am sure we all felt much safer that the boy who once had a girlfriend 2 years and 2 months younger, completed college in prison, can't pick up his kids at school. The ass kicker is we have since added a Romeo and Juliette law (he was convicted in Florida) making what he served 2 years for and got on the registry for, no longer a crime, but it did also add a process for removal from the registry and expungement for those whose conviction now falls under the Romeo and Juliette clause. Sex offenders had always been blocked from expungement prior. I know for sure he was granted removal from the sex offender list, not sure if he was able to get expungement though

but flip side, 19 year old Frat boys "borrow" the school's golf cart, and do donuts on a lawn while some surf using skate boards. That is felony grand larceny. So even if he paid back any damage (if there was any), served 30 days, paid all fines, did 5 years probation no problem, got married, had kids..... Well felony grand larceny still looks really bad to employers years later. Are you really that concerned that that man who was golf cart boy is a hardened criminal unsafe to work in the marketing department of your office. This exact thing has happened at many universities, I don't know what it is with boys and golf cart joyrides but I do think a dumb ass clause for criminal records could be appropriate. Employers can only go back 7 years in some states on criminal records, some 10 years, some no limit. should golf cart boy really be unemployable 30 years later unless he moves to a state with some historical protection because grand larceny is one of the biggies employers hate. he was a young dumb ass, not a hardened criminal.
