This is about a bunch of Asian guys who wanted to name a band using a word some other Asian guys found derogatory.

This isn't about the larger issue of hate speech designed to inflame or antagonize and cause harm.

The problem is, most "hate speech" laws have attempted to "liberally" abuse the legal standard laid down by the Supreme Court in the 1969 case of Brandenburg v. Ohio. In order for speech to be restricted under that standard, it must be:

1. Intended to incite violence,

2. Likely to produce violence,

3. And the violence likely to be produced is imminent.

ALL THREE elements are required to Constitutionally sustain the sanction. The vast majority of hate speech, no matter how vile, typically falls short of the "imminent likelihood" elements.

Actually I think it is more that during Obama's years, there weren't riots in the street against him before he was even inaugurated. So at that time, it was artistic expression.

Now that there are riots and angry mobs, the same events could be said to be the equal of gasoline on a fire rather than artistic expression.

U.S. Rep. Jason Chaffetz told a Utah newspaper Wednesday that he was the target of a Winter Park man who threatened to hunt him down and hang him from a lamppost.

Charles Zachary Howard was arrested in March after he was accused of calling a congressman’s office in Washington, D.C., and leaving a voicemail filled with profanities and threats, according to federal court documents.

Until Wednesday, it was not clear which congressman Howard had allegedly targeted. Chaffetz, R-Utah, confirmed his involvement during an interview with The Salt Lake Tribune about lawmakers’ safety in the wake of Wednesday’s shooting at a baseball field in Virginia.

In the voicemail, Howard cited the KKK, Freemasons and Nazis and suggested the congressman should prepare for the “apocalypse,” prosecutors said.

“...We’re going to hunt your a-- down, wrap a rope around your neck and hang you from a lamppost,” part of the voicemail said.
