FBI's Director, James Comey has sent a letter to Congress

Dear Messrs Chairmen:

In previous congressional testimony, I referred to the fact that the Federal Bureau of Investigation (FBI) had completed its investigation of former Secretary Clinton’s personal email server. Due to recent developments, I am writing to supplement my previous testimony.

In connection with an unrelated case, the FBI has learned of the existence of emails that appear to be pertinent to the investigation. I am writing to inform you that the investigative team briefed me on this yesterday, and I agreed that the FBI should take appropriate investigative steps designed to allow investigators to review these emails to determine whether they contain classified information, as well as to assess their importance to our investigation.

Although the FBI cannot yet assess whether or not this material may be significant, and I cannot predict how long it will take us to complete this additional work, I believe it is important to update your Committees about our efforts in light of my previous testimony.

So, they will look at the emails?

And that doesn't give you a clue that the e-mails in question (apparently none from her) aren't as damaging as the impression given?--a position that even a scheming politician (and, yes, she's a scheming politician--for some of us that ain't always a bad thing to have in a president. Better than a stumbling dolt) wouldn't take if she didn't know this was the best position to take--ergo that it doesn't really implicate her in anything.

The classified information angle doesn't mean nearly as much to someone who has worked in the government with classified information as it does to someone on the outside who just wants to take any opportunity they can to string her up. When you're on the job, there's some leakage in the gray areas of what was from classified sources and what wasn't, and we're talking about a miniscule number of e-mails that had any classification on them. I doubt there's anyone who was in government during the period she was who didn't experience some of that minor leakage. I can guarantee you that if she'd been using State communications rather that her own server, there would be a massive amount of classified information leaking out--that's what State is famous for. And please do try to wrap your head around the 22 million e-mails under subpoena that the Bush administration destroyed without you giving a peep. All depends on who you're after and who you're not, right?

Actually, Secretary Clinton demanded that the FBI Director release the facts in regard to this new discovery ASAP. I think this indicates that she is not trying to hide anything that may come of it, but refuses to accept the ridiculous statement from the Director indicating he had no idea how long it would take to resolve this...or even if there was anything to be found! It seems to me that the FBI should have done a little bit more investigation before making any statement. Bottom line, in my opinion, there better be a lot of agents working around the clock so a full disclosure can be made tomorrow. Either shit or get of the pot, but this whole thing is looking like the 'Keystone Cops', regardless of what is or isn't in the emails.

And if everyone might recall, Secretary Clinton has always said, 'to the best of my recollection' she never sent classified info.

I think we should all be open minded...if she's found to be a crook, then we can say that...if no charges can be made after the millions of $$ spent trying to find something (anything), then maybe calling her a crook (or lying scumbag) is a bit premature?

Instead of due diligence, media outlets substituted the spin of Republican congressman Jason Chaffetz. They completely ignored that Chaffetz just days earlier had promised to launch endless investigations of Clinton from the moment she was sworn in. As more information came out, journalists began criticizing outlets for so easily failing for false Republican spin. This led to the humiliating spectacle of outlets being forced to walk back their over the top headlines within the span of an hour. The fact is that Chaffetz had spun the media with patently false information previously and the media should have known better.

According to news reports, the FBI now is planning to get a warrant to search the laptop for emails related to the Clinton server case. They haven’t obtained that warrant yet, however, so the Weiner computer has not yet been subject to a comprehensive search.

DOJ goes out of its way to avoid publicly discussing investigations close to election… Not just public discussion either. Often won't send subpoenas or take other steps that might leak until after an election is over… Why? Because voters have no way to interpret FBI/DOJ activity in a neutral way. Who is the target of an investigation? What conduct?… This might be totally benign & not even involve Clinton. But no way for press or voters to know that. Trump seized on FBI Director James Comey's announcement Friday that he is at least temporarily continuing an inquiry he had previously declared closed. Democrats frantically demanded answers about the scope of Comey's additional inquiry and questioned the timing and motives of his announcement.

"As you've heard, it was just announced yesterday that the FBI is reopening their investigation into the criminal conduct and the illegal conduct of Hillary Clinton," Trump said.

That was a broad overstatement. Comey recommended in July that Clinton not be charged in the case and his letter to Congress on Friday said that it is unknown if the emails now being reviewed are significant.

But the crowd at the Trump rally roared.

"Hillary has nobody but herself to blame for her mounting legal difficulties," he said.

"Her criminal action was willful, deliberate, intentional and purposeful," he continued. "Hillary set up an illegal server for the obvious purpose of shielding her criminal conduct from public disclosure and exposure," he said, "knowing full well that her actions put our national security at risk."

Trump floated his own theories, shifting focus away from his own controversies in the hope of scoring a last-minute surge in an race that even his staff admits he's losing.

He said the only explanation for the FBI move is that "very, very serious things must have been found."

Trump stuck closely to a theme that has held resonance throughout the long presidential campaign - the idea that the nation's political system is corrupt and weighted toward those who already have power and money.

"Hillary Clinton's corruption is corrosive to the soul of our nation and it must be stopped," he said.

He invoked the history of scandal or controversy attached to Clinton and her husband former President Bill Clinton.

"Haven't we had enough drama with the Clintons?" he asked.

As he did earlier in the day in Golden, Colorado, Trump congratulated himself for suggesting that former U.S. congressman Anthony Weiner's connection to Clinton could trip her up.

"I had no idea it was going to be that accurate," he said.

This lack of information about the newly discovered emails, as well as the timing of Comey's announcement, has drawn scrutiny from former officials. One former senior DOJ official, who requested anonymity because he has pending matters at the department, told NPR that Comey's first mistake came in July, when he held a press conference to announce the findings of the FBI's investigation into Clinton's email use.

"You don't hold press conferences to announce that someone should not be charged with a crime and then proceed to dump all over that person and to publicly discuss the evidence against them," he said. "That's kind of one of the 10 commandments for being a federal law enforcement officer. And another commandment would be —

you don't publicly announce that you're conducting a criminal investigation against someone. And you especially don't do it if that person is a candidate, 11 days before an election. That's true whether it's a presidential election or an election for dog catcher."

In or out of a 'normal' election season, Comey would be unemployed tomorrow (Monday), fired for insubordination and violating long-standing department and bureau policy -- which would only feed the Trompsters' frenzies.

Comey could save his job tomorrow by announcing prosecution of Tromp on charges of fraud, bribery, finance violations -- to the same effect, probably provoking arson at federal offices around the nation.

Why would Comey do this ?

Comey is on his way out.
He had the power to influence a presidential election.
He was a good Republican soldier that broke the law.
He is a lawyer, and a Director of the FBI.
He has plenty of answers to give to the judge that oversees his case.
Plausible deniability of responsibility ?
It was not his intention to harm Hillary Clinton's campaign.
It was not his fault, when Trump jumped to conclusions and gained an advantage over Hillary Clinton.

Will Comey declare that he did not intentionally engage in misconduct.
(Despite the fact he was warned not to interfere with the election by his boss at the DOJ.
His actions were not an indication of disloyalty against the United States.
(He wrote a letter to Congress to inform. He wrote an explanation.
He documents outline his intentions.)
His efforts were not intended to interfere with a presidential election.

Not his fault that others jumped to the conclusion that the case against Hillary Clinton would be reopened, and that there was evidence in the new Huma emails that implicate Hillary.

If Clinton loses could she sue him for her failure to get elected ?

Anyone can sue anyone for anything, that doesn't mean that they will win the case.

The key points are:
  • Comey was not pursuing this case at the time. The new information came to light in a separate, unrelated investigation.
  • The reason this new information was uncovered was because Huma Abedin lied to the FBI when she told them she had had turned over (in exchange for immunity) all of of her emails and devices; and because she was married to man who liked to perv on underage girls.
  • The FBI investigators looked at the metadata of the 650K emails on Weiner's laptop for potential victims and discovered mail from\sent to the IP address assigned to the MX record of the clintonemail.com domain.
  • The FBI used the metadata from the emails to obtain a search warrant (which was delayed for "unspecified reasons") to have legal standing to examine the senders, recipients and content of the emails.

Comey was basically fucked. If he didn't disclose the new information, which landed on his desk, he would have been accused of politically protecting HRC. If he did disclose the new information, he would be attacked, as he is now, by the Clinton campaign and the MSM.

As an Independent, with no dog in this hunt, I'm all for full and complete disclosure.

It's sad that, in this election, our only major candidates are such corrupt, morally reprehensible human beings.

According to some news reports, the letter was sent before the F.B.I. had even obtained the search warrant that it needed to look at the newly discovered emails. And it was sent days before the election, when many Americans are already voting.

Violations of the Hatch Act and of government ethics rules on misuse of official positions are not permissible in any circumstances, including in the case of an executive branch official acting under pressure from politically motivated members of Congress. Violations are of even greater concern when the agency is the F.B.I.

No, actually this had nothing to do with Clinton or her emails. Wiener was under investigation for elicit contact with an underage (fifteen year old) girl.

Upon examining the shared laptop, they discovered that one (or more) email accounts had sent and received emails from the illegal\rogue clintonemail.com mail server.

At that point, the FBI requested a search warrant to examine the contents of the various email accounts on the laptop, which after being delayed, was finally granted.

Well, who knows at this point. The FBI has no legal standing to examine the emails on Weiner's laptop without a court order to do so, which has only just been granted. (after much delay). So, time will tell.
