The courts can't make up laws as they go along. The Hammonds were convicted of arson of federal lands, that carries a five year minimum. No court in the land can change that.

Worked out well for the Indians? Please citation is needed on the interactions of the BLM and the Native Americans cus that sounds straight made up. If you mean don't trust your government. . .we weren't their government for most of that time. As I recall it wasn't until post WW1 that it was universally settled that they were Americans and not some weird psuedo-independent nation(s). And they really didn't have much alternative.

Fine and dandy, BUT it is what they are doing or threatening to do with said guns they carry that would be illegal. Them being sentenced twice for the same crime is a bit iffy, but going through a legal appeals process seems to be a better choice than their present one.
