The fundamental question, I believe, before the Court is if same-sex marriage is a constitutional right...

...which it absolutely is not, just as marriage of any kind is not.

This is exactly the prototype kind of cultural issue the framers deemed to be the province of the States and the People to decide, and which the 10th was amended to ensure without any doubt...

...that States and their People will decide differently on the same such cultural issue(s), and that that constitutional diversity would highlight the strengths and weaknesses of any issue, so that from these 50 different experiments, the best ideas could surface to the top.

The specific purpose of the Constitution is to grant the federal government omnipotent power in intentionally- and greatly-limited, precisely-defined areas that intrude the least upon the individual liberty of all...

...and to command all other power of governance to the States and the People.

Statists, being the natural enemies of individual liberty, despise constitutional diversity and the Constitution's definitive prohibition on their socialist heart's true desire: federal government power/definition over every minutia of life.

Thus, a decision against same-sex marriage in this case is not a verdict on the actual act itself, but the current Court recommitting itself to the very most fundamental political principles a great republican nation was founded intentionally upon.

Conversley, if the Court rules marriage is, indeed, a constitutional right, then the Court is simply further exasperating its bastardity of unconstitionally allocating legal powers to itself.
