For the Judicial branch to do what the Legislative branch should have done is also a violation of the separation of powers clause.

Schwab is a real gem. Not much of a stickler for proper procedure when someone he does not like is anywhere within reach.

The backflip he did to get to reach out and get an opinion on the applicability of the President's policy (which does not apply) when it was not even an issue raised by the defendant is very telling about his motivation here.

There is no "should have done" the legislative branch is empowered to write legislation, not required to do so, much less to the liking of the executive branch.

Democrats rightly used the power of the purse to shut down the Vietnam war specifically by refusing to authorize through legislation the very real needs that the commander in chief needed to prosecute a war in progress.

No they aren't required/made to write legislation. It is simply their responsibility to do it, as they have the power to introduce it. The president doesn't stand over Congress saying, "Make a law! Now!"

I like the phrasing there, "responsibility." Their responsibility is to do the will of the specific people that elected that representative. Sometimes that means write a new law, sometimes that means repeal one, some times that means put the brakes on bad legislation from the other side. Republicans have both houses. It is not the "responsibility" of the Democrats to go along with every item the Republicans want. Some things the republicans want their voters do not and it is their responsibility to object, within the bounds their numbers allow.

Sometimes it amounts to any of the things you've just mentioned but if it was the will of the people we'd just set up American Idol and call it a fucking day. Sometimes it amounts to any of the things you've just mentioned but if it was the will of the people we'd just set up American Idol and call it a fucking day. There is literally nothing in this country that happens to quickly to wait until a few million Americans weigh in.

They have many responsibilities. That is certainly one of them. But those are ethical, moral duties. One of their actual jobs is to introduce legislation. But they certainly don't have to, like a homework assignment: every night, make a law. Bring it in by Monday. Lol no. :eek:
