Winston Churchill had a similar attitude at the end of WWII when he wanted to skip trials and treat the Nazi leaders as by definition "outlaws," without legal rights or protection, and subject to summary execution. ("Outlaw" was an ancient concept in Anglo-Saxon law, in disuse long before the Norman Conquest -- if a man was declared outlaw, any man could lawfully kill him.) But, Churchill was wrong, and the Nuremberg Trials were worth having and did what rough justice could be done under the circumstances. And we're talking about guys with body counts much higher than 77.
