Charge Moms with Trafficking Drugs to Newborns?

If a woman is doing drugs when pregnant, she passes the drugs to her unborn child via the umbilical cord. The child is unborn, so some may say the child has no rights and the Mom cannot be charged with drug trafficking. However, then the baby fully exits the womb, the umbilical cord is still intact.

Before the cord it actually terminated, there is a period of time whereby drugs will pass from the Mom to the baby. In this circumstance, should the Mom be charged with drug trafficking? Or does she get a pass?
 
You can be charged with child abuse. My little brother was born addicted, and went strait to my grandparents. But, he was the third case- it depends on your track record, usually, they'll just put you on methadone, and if you do your treatment, you can keep your kid.

This is actually a very serious problem in my area. This is actually a trigger-button issue for me. The law in ky is that if the mother goes to the clinic once every 6 months, she can be awarded custody, even though she's a horrible neglectful monster who cares way more about her drug habit then her child. I've seen women keep custody of kids in Halos, who have spinal disorders... There's actually a group called "Fathers for the Commonwealth" who are trying to find ways to combat this problem. But for some reason, the law says that the biological mother is the best person for custody, because it "keeps the family together".

When I used to volunteer at the hospital to do murals in the pediatric ward it would piss me off so bad to see these kids crying for their moms, even though she was the one who put them in there. You'd see kids with tact marks up and down their arms because their mothers used them to test their shit. And those kids would cry to see her. It just... broke my fucking heart.

Sad stories. I think they shroud be charged with drug trafficking.
