Jason Elia told ESPN 97.5 in Houston that he is giving his tickets to the person who gets him the most Twitter followers. Elia, a television writer who lives in Nashville, spent $8,000 on two tickets to Super Bowl XLVI in Indianapolis at Lucas Oil Stadium. He was going to take his football-loving girlfriend to the big game, but his plan went kaput. On November 7, he found out he had bladder cancer. When he told his girlfriend, she dumped him. In an interview with Trending Now, Elia said his girlfriend "could not handle the stress of having a boyfriend with cancer." To make matters worse, Elia was planning to propose to her on Christmas. Perhaps the cruelest twist of fate is that his ex-girlfriend still wanted the Super Bowl tickets. According to Elia, his ex-girlfriend says the tickets are rightfully hers because he bought them with her in mind. Well not only is Elia not giving her the tickets, he also held a contest to get rid of them.

I honestly think that legally she should get them. He bought them as a gift for her. She left him because he had cancer and she told him she wouldn't be able to support him and didn't want to be a bitch by pretending. Harsh, but true. I'd be pissed- and I would have sold them. But I think, legally, she gets them. But, if she takes it to court, the morality of the case is going to be taken into account, even though it isn't supposed to. "Cancer" is a buzzword. Actually I and millions of others call this woman's move a NEWT GINGRICH move. I was protesting the way he dumped his cancer-stricken wife back when I was a Republican. Back then I didn't even know he dumped another wife for another illness as well.

In fact, I believe 'Gingrich' is now a popular slang term listed to describe someone who forgets the whole "in sickness and in health" thing.

well considering that he still holds the tickets. He bought them with the two of them in mind, going to the game together. He never handed the ticket over to her as a gift. Therefore I don't think she has a leg to stand on. Anyway you look at it, its going to cost her more then $4,000 dollars to fight it in court, if she wanted to.

I think they are his to do what he wishes with them. If it had been a gift for her, he would have given her the ticket. There are so many ways this can go.

I think you can apply the same case law as an engagement ring. Legally the ring is a promise to get married and does not become the womans till that contract is complete.
