Sad / infuriating story from Rutgers University - what should their punishment be?

Short version: a guy sets up a secret video camera to film his roommate while he's off with his girlfriend. The camera catches his roommate having sex with another dude.

The guy - and, presumably, his girlfriend, who also knows about the camera - thinks this is funny, and tells people on Twitter. He then sets up the camera again, but this time alerts people on his Twitter account that they should watch his gay roommate getting it on live on a streaming feed, because he knows when it's going to happen. It happens.

Gay roommate finds out about being secretly streamed live on the internet. He kills himself.

I was thinking the same thing, what with stuff like microchips and fiberoptics and such. No such thing as privacy in a dorm room any more. Had I been in college in the '10's instead of the '80's, there would probably have been footage on the web of me and the future Lady P getting it on. People were certainly attempting to find us out.

It's an awful story. The filming, the broadcasting. It was an invasion of trust and decency, and those who did it were bone-headed in the extreme.

But the choice to kill himself over the revelation of his homosexuality was the young man's own.

That is the crux of the matter.

Most things like this are settled with a "no harm-no foul" ruling. In this case there was harm, but what was the foul?

It is a crime to film someone without their knowledge. Any death resulting from or during the commission of a crime is considered murder. Most states have this kind of law on the books. If a clerk has a heart attack and dies during a robbery, the robber is charged with murder.

The dead man had a parter on the film, who we presume is still alive. This proves it is possible to survive being filmed while having gay sex.

I would like to see the guy who started all of this prosecuted for the camera trick. The opportunity for this kind of thing is all over the place and will become much easier in the future. That is real lesson to learn from this tragedy.

David Horowitz, Michelle Malkin, and Thomas Sowell saying Wichita was a hate crime, doesn't actually make it so. Not EVERY crime by a white against a black is a hate crime and vice versa. Further, there is no evidence to suggest that this was in any way racially motivated.

The only thing that would make this a hate crime would be homophobia and going from the scant reports so far, there isn't much evidence for it. Sometimes a victim just happens to be a minority or different from the perpetrator. It's only a hate crime if the victim is targeted BECAUSE they are different. It is a difficult idea for a knee-jerker like you to get your head around, but do at least try and think before blurting. You are in danger of ending looking as dumb as jen or offtobed otherwise.

I read this story last night (with additional interest because I'm a Rutgers graduate), and it is so so sad. I do think this comes under the category of hate crime, ethically if not legally.

I know the areas these kids come from very well, having grown up in Central Jersey. And having been a teacher there once, too, I know the type of kids the two accused are: upper middle class kids who grow up cosseted and with a sense of entitlement and the feeling that their families can buy their way out of anything. If the roommate who filmed the boy who died was so homophobic he should have asked to have his room assignment changed. I'm sure as he matures he'll deeply regret not having dealt with his homophobia in a less hateful way. Maybe there's a lesson in this for parents. We need to raise our kids to accept diversity and not be so threatened by it that they have the potential to ruin lives, including their own.

I doubt they can be charged with anything beyond invasion of privacy, so they'll likely do little if any jail time. And I agree with Liar that there will be a civil suit; it's the best way the families of the kid who killed himself and the other kid can get any kind of justice.

So how many lives are ruined because of this? Not just the poor kid who jumped off the GWB, but the roommate, the girlfriend, their families? So sad. We need to teach our children to keep the Golden Rule as a critical value in their lives.

I think you're assuming facts not yet in evidence on at least two points: that they knew it would be psychologically damaging, and that it directly led to the suicide. This is still a developing story.

I think it's probably easier to assume the illicit streamer just thought it would be a laugh riot a la American Pie than something meant to hurt his roommate. Can we assume he wouldn't have done the same thing had the roommate been fooling around with a girl? Remembering what me and my friends were like at that age, I'm guessing the answer is no.
 
Seems like a piss poor excuse to kill yourself. And I haven't looked that much into this simply because it's a piss poor excuse to kill yourself so my sympathy is right near zero but I haven't seen anything that says they did it because he was gay. Just that they did it. That doesn't sound like any kind of hate crime to me. Maybe I missed something though.
