His "finding of fact," seems to me to be a bogus lists of all the gay propaganda he accepted as incontrovertible evidence, his justification for arriving at his bogus decision, but falls short of a real justification for throwing out an election result. Personally I don't believe a single Federal judge should have the jurisdiction to throw out an election result and Congress ought to rein the courts in. I think it should go right to the Supreme Court.

His 'findings of fact' were the consolidation of the testimony in front of the court. The State of California didn't want to fight the plaintiffs, so other groups stepped in. The evidence they presented was not credible. Their 'expert' witnesses were not qualified in the areas that they were supposed to testify about.

This is a democracy, majority is supposed to rule, but not with the liberal minority coalition who scoff at the democratic process and advance their agenda legislating from the bench by fiat. BTW it's twice been the will of the people. :rolleyes:

We are also under the illusion that our vote counts. That we are a nation of by and for the people, yet when the people speak a fascist overrules them.

Why don't we just install a federal judge in our Congress, in our state legislatures, our city councils, and place before him/her our legislative proposals, so that he can explain to those bodies what the people should or should not need, and the proper construction of said legislation, so that the people might apply their imprimatur with the correct vote satisfactory to the state?

No comparison, The SCOTUS found the Fla legislature violated the law. We are talking here about a ruling by a single judge throwing out an election that did no such thing.

In the ruling for Bush, he had a lead of some 2000 votes initially and was ahead in the recount when the SCOTUS ruled there were violations of equal protection in the varied standards of recounting methods county to county. Different animal.
