"It doesn't matter if you have a legal license or not. The census wants to know how YOU consider yourselves. If you consider yourself married, check the box that says so. If you don't, check the very last box, the one that says "Unmarried partner."

I think this is going to be especially fun, since I'm going to be a census taker. I want to see the looks on some of the faces around here with all the homophobes we have here in the bible belt.

I was wondering about privacy, actually, and the safety of any couple who out themselves this way?

Totally 100% safe. Many groups are worried about this - I read an article that quoted Arab-Americans afraid to reveal their ethnicity. Here's what the government says:
There are only 10 questions on the 2010 Census questionnaire. Completing the form is quick and important for your community, and the US Census Bureau is obligated to protect the privacy of your Census answers. Your personal information – name, address including GPS coordinates, and telephone number – may not be shared with any government agency including law enforcement, the Internal Revenue Service, or the courts. All Census workers are sworn for life to protect the confidentiality of the data. It is a violation of Title 13 of the US Code to share confidential Census information, and the penalties are severe.

The penalty for unlawful disclosure is a fine of up to $250,000 or imprisonment of up to 5 years, or both.

I haven't seen a form, though. Got a postcard saying "you should've gotten a form by now, please fill it out" but I haven't gotten the actual form, unless I missed it.
