People write unconstitutional laws all the time, Box. They last until some tireless lawyer knocks them down with a test case, and in the meantime people get to do shit the drafters of the law knew was wrong. They disqualified every vote, in North Carolina in the 2000 election, if it named anyone for President who was not the stated candidate for one of the two major parties. Nader, write-ins, anyone. Not constitutional, but it worked through the period of the election, which was all it needed to do.
Mixed-race marriages were found to have this protection in the Jim Crow South, but they had laws saying otherwise in some places. So, they lynched. When people want to be assholes, they won't take no.
