No. Her opinion was overturned. Her nomination is a separate issue.
With any intelligence (OK get off the floor) from the Senate, this raises enough doubts about her judgemnt to disqualify her.
Why is it that no one accepts or understands the nature of competing ideas thus political parties? The table will always be tilted as one side or idea gains power, exercises it, then loses power and the factors shift.
It is called 'competition' within a democratic framework, thas the way 'tis supposed to work.
But this Supreme Court decision against affirmative action could be the beginning of the end of the quota system favoring women and minorities over merit.
That would be a good thing.

I think the most embarrassing Supreme Court ruling lately was the 8 to 1 decision that strip searching a 13 year-old girl for aspirin was unconstitutional - embarrassing because Clarence Thomas was the lone dissenter. Talk about affirmative action, I seriously don't think he'd be on the court if he wasn't black. I mean, does anyone here think he was picked for the court because of his intellect?
In that light, I think it's rather ludicrous to complain about Sotomayor's appointment.

correction: jimmy, Sotomayor was launched into the federal judgeships by Bush the Elder. seems that spic votes count the same as anyone else's.

All of JBJ's racial innuendo aside, I rather think Sotomayor was picked by Bush the Greater primarily because she was Hispanic. The Bushes were the first of the presidential contenders who understood and went after the Hispanic vote. One of their smarter moves.

iirc, McCain, lost Florida in part because he couldn't keep the percentage of Hispanic votes that GWB had, when he carried it. Republicans at times have gained through courting minorities.
