The last thing gays want is for SCOTUS to get a crack at it. If it cant fly on the Left Coast, it cant fly.

The decision today was not the one I hoped for but the one I expected. What saddens me most is that only one Justice dissented.

Regardless, the opposition to equality in marriage is literally dying. Every year that passes brings us closer to eroding their slim margin.

And I will at least take solace in the knowledge that for the 18,000 couples who did marry while it was legal, the court reaffrimed those marriages.

The bigoted and zealot-filled opposition may be able to get the constitution amended, but they can't get a law to go into effect retroactively. And every single one of those 18,000 marriages stands as an example of the utter stupidity of Prop. 8.

The zealots children look at them with confusion and puzzlement as they try to explain why Prop. 8 is important. And when they get to vote on it, they will not support segregation.

Yep. The opposition is gasping its last pitiful breaths. Maybe you guys can mount a rousing effort some other place, and Chucklewood can join Mayberry, Hooterville, Pixley, and Massachusetts in approving same-sex marriage.

It will gain more support as time passes, and as the liberal NorthEast continues, state by state, to push forwards in legalizing gay marriage in their states.
 
Also, as Imp hints at, we now have 18K LEGAL marriages in California that are also Unconstitutional plus all the people who get married in other places and move. What happens with property law? Inheritance? Taxes?

I'm sure there are already lawyers playing with that conundrum.

The ban won't last. I'm sad to see it continue a single day, but I am confident of it's eventual failure.

Once Amy and I can get all of the legal mumbo jumbo, we've had to implement to protect our children, straightened out, we will be two of the 18,000, but so what? We still need to "prove" that we are legally married even in California, by producing the appropriate documentation, before we can do ANYTHING that a hetero couple can do without question...

Don't get me wrong. I am happy and joyful that we did what we did and that I am now Amy's legal spouse. But my happiness is emotional and my joy is greatly diminished by my thoughts abour the millions of people who have now "constitutionally" been told by the state of California that they are freaks and don't deserve the same legal protections that other's enjoy. It is time to move out of here and leave this state to rot in it's own stink.
 
Gain more support as time passes? YOU JUST LOST YOUR ASS IN THE BIGGEST STATE IN THE UNION.

Same sex marriage doesnt have a prayer in Texas or Florida. So that leaves New York and the Seven Dwarfs.

Before long, there will be a SCOTUS case requiring states to recognize marriages -- ALL marriages -- from other states. There is already legal precedent in terms of elopement and adoption. Legally-binding in one state is legally-binding in every state. Period.

If one approaches marriage as a legal cage (instead of a privilege), then the way is already paved. We just need a same-sex couple to sue for divorce in a state in which they were not married. Fight over the division of property, custody, etc. It'll happen.

A petition with sufficient signatures. This translates into sufficient money to hire signature collectors. Then the sigs are compared to the list of registered voters so that it can be placed on a ballot.

The repeal of Prop 8 has several things stacked against it, the most important being that in by-elections, only the most reliable voters turn out and that happens to be those over 60 who naturally hang onto the status quo. However, I have the impression that this time around Hollywood and the Silicon Valley will seriously open their wallets. This issue isn't done and in spite of the chortles of the homophobic trolls, we who laugh last will laugh best.
 
Without quoting the poo flinger, he's right. To get a measure on the ballot to make a change in the state constitution, which is now what would be required, signatures totalling 8% of the vote in the most recent gubernatorial election are required. Here are more details:

ETA: According to this: http://en.wikipedia.org/wiki/California_gubernatorial_election,_2006 that means a total of 200,473 signatures. Of course, it's always best to have some to spare because some may be disallowed for diverse reasons.

Florida has shipped emancipated kids back to Michigan forever. Michigan used to emancipate their delinquents and put them on buses for Sunny Florida. We sent them back because kids arent emancipated down here.

Florida married children until 1926, if we resumed the practice today no state would recognize such a marriage.

IMPRESSIVE confuses the issue, assuming that the resident of one state is the resident of every state. This is her point. Other states have to accept your special condition for purposes of transit, but theyre under no obligation to accept the citizenship conditions existing in other states if you apply for citizenship where you move to. You cant practice medicine if you visit Florida. You cant practice law.

So if you and your same-sex honey share a motel room here we wont arrest you for violating laws against it.
 
It's a temporary set back...that's all.

The ruling today provides plenty of fodder for the GLBT community legally. The ruling essentially establishes inequality within the GLBT community in california.

It won't be long before suits are filed for those seeking the same rights that the exsisting 18K have. And the ruling will be overturned.


Plus....the amendment passed with 52% of the vote. In a few years that percentage will diminish.

(the similar amendment in Florida passed with 61.2%....and 60% was needed to pass...so we are in a similar situation)


This IS gonna go the SCOTUS.

And I do believe that relatively soon, all this will be just an unpleasant memory.

If it goes to SCOTUS they'll rioll in barrels of KY for the occasion, and I guarantee you wont like the results. BECUZ the issue wont be limited to saqme sex marriage. Polygamy, child brides, and every combination and permutation of union will be at stake.

A major expense of getting an initiative on the ballot is collecting signatures because this is usually done by professionals who get paid by the name. However, volunteers can do the job as well and as legally and for free, if they are willing to put themselves on the line physically as well as vocally and morally and financially. :cool:

The battle raged for several years, and its over. THE SOUTH IS NOT GONNA RISE AGAIN IN CALIFORNIA.

the ruling will be made on the premise of the constitutionality (sp) of the ONE argument before the court. If others choose to bring suit within time...they will be heard at that time.

Gays make the collosal political blunder of waging war without allies. Gays forget or ignore that nuthin happens unless there's something in the fight for everyone. I made this observation months ago.

Toss me something and I'll vote for it But this aint gonna happen. People need a reason to get of their asses and go vote. I'm surprised no one on your team has the political savvy to know this.
