There is no cause for firing, therefore it violates the law created by Congress.

I don't need to tell them their job. The law isn't ambiguous. Unproven allegations aren't cause....they're pretext nonsense.

Here are some of the reasons I don’t think Cook loses her job:

- She hasn’t been convicted of anything. In fact she hasn’t even been charged with anything. Trump would have a stronger case if there was proof of wrongdoing.

- Even if she did falsely file mortgage applications, if it happened before she joined the board it would weaken the “for cause” argument.

- In an unsigned opinion in a case where the Court this spring let the President remove National Labor Relations Board and Merit Systems Protection Board members (Trump v. Wilcox), the court made a point of specifically stating that the opinion doesn’t necessarily apply to the Fed.

“The Federal Reserve is a uniquely structured, quasi-private entity that follows in the distinct historical tradition of the First and Second Banks of the United States”

I dispute that point. She sits on a board that sets the mortgage rates for the rest of the nation. If she engaged in mortgage fraud, even if the statute of limitations has run its course, she needs to be removed.

So are you saying that her engagement in such activity is alleged or is under investigation or is proven?

Maybe. It depends on how the core issue is framed.

Was she just fired and the Government is merely claiming cause?

Or was there an investigation into the belief that there's been criminal behavior and the resulting appearance of impropriety/lack of confidence and she was terminated for cause after the findings were reviewed by the investigators?

In the first, she'll win.

In the second, the Government will win. Being appointed to a position doesn't bring with it total immunity against termination if the appointee is a bad actor or the public loses confidence.
