Ah, so the Constitution only applies to the circumstances that existed on the day the amendments were passed (according to Trump).

Undocumented immigrants running from the draft in foreign lands should be deported, including their descendants even unto the fourth generation. That's something we may be able to get behind.

What you don't seem to understand that Justice Roberts does is that NONE of those inferior courts are constitutionally mandated. Further, congress can cut the shit out of the Courts budget through the reconciliation process. Roberts is acutely aware of the sense of congress and how out of control some of the inferior courts are. I expect him to act out of an attempt to protect the judiciaries integrity and his own powers.

It's FAFO time.

Actually, I think it depends on the shadow docket, which may wait a little longer due to the way it's scheduled.... But as soon as it hits SCOTUS, this is toast

The 9th Circuit has gotten away with being The Self-Proclaimed Progressive Branch of the Gov for a long time.

This ruling should eventually lead to congress doing their job. I believe sooner than later a 3 maybe 5 judge tribunal will be establish to rule and remedy national cases. IMHO

I may be wrong but I believe the 9th circuit can rule on national issues, it's the district court judges that rule outside their lane.

More likely it will necessitate the creation of a pleading standard to establish national jurisdiction. Much like what's required to establish subject matter or personal jurisdiction.

Attempting to plead with non-existing plaintiff's, like what CASA is doing here, is not only stupid but should get them sanctioned for a frivolous filing.

The circuit appellate courts were also created by Congress. Accordingly they'd be bound by the decision.

I think it will eventually result in the end of wholesale forum shopping, but some forum shopping will still take place. Those with a lawfare agenda will still be able to find judges amenable to their cause who are willing to use their authority to support any national implications in the pleadings to establish a national injunction.

Under the FRCP, for pleading purposes all allegations in the pleadings must be assumed to be true. Thus, an allegation that the suit has national implications because XYZ should be enough to establish national jurisdiction for injunctive purposes.

If you read the new CASA pleading they're seeking a class action certification for all children born after Trump took office and all who are yet to be born.

It's completely frivolous because you cannot fashion a remedy for someone who doesn't exist.

If there was an EO to take guns and the NRA sued over it, and was issued an injunction, that injunction would not stop the government from taking your guns.
