The lingering question, of course, is who may have been using the autopen on Biden’s behalf without his knowledge or consent. An explosive New York Post report revealed a disturbing pattern of potential power abuse within the Biden White House, centered around the controversial use of the presidential autopen.

While the New York Post didn’t name the staffer, speculation is swirling around Neera Tanden. A longtime left-wing operative, Tanden was Biden’s controversial pick to lead the Office of Management and Budget — until her nomination collapsed over a slew of hyper-partisan attacks on Republican lawmakers. She later found a role as White House Staff Secretary. Now, she finds herself at the center of this constitutional crisis.

The timeline is damning. On Dec. 30, 2022, while Biden was allegedly golfing in St. Croix, six pardons magically appeared with his signature.

Tanden's response? A desperate attempt at deflection, trying to turn the tables by questioning Trump's own autopen usage.

We will never really know the answer to that question. However, since there's no evidence to prove it wasn't authorized, the presumption must be that it was.

Given that, I wish this subject would just go away. It's stupid and detracts from the accomplishments this administration could achieve without it being in the way.

Ed Martin’s nomination to serve as DC Attorney was nuked by Republican Sen. Thom Tillis (R-NC). He was in office on an interim basis. Trump selected Jeanine Pirro to replace Martin, who is now a pardon attorney and helming the Department of Justice’s weaponization task force. Martin is looking at Biden’s pardons, specifically the ones issued toward the end of his presidency. They might not be legal. It comes off allegations that Biden aides might have illegally used the autopen. President Trump has asked who was behind the autopen since it’s become clear that Joe Biden was not mentally cogent enough to know what was going on (via The Hill):

Bauer and Dunn are married, with the former being present for Biden’s deposition with Special Counsel Robert Hur, who was investigating Biden for mishandling classified documents while serving as Obama’s vice president. Bauer claimed that Hur’s account of events wasn’t how he saw things, which made the case for releasing the tapes. Portions were leaked last week where Biden, indeed, sounded awful and forgot when his son, Beau, died.

The Oversight Project is questioning "who controlled the autopen" because "they controlled the presidency."

The Oversight Project, an investigative arm of the conservative Heritage Foundation, alleged an excessive use of autopen signature by former President Biden when he was in the White House.

"We gathered every document we could find with Biden's signature over the course of his presidency. All used the same autopen signature except for the announcement that the former President was dropping out of the race last year," the organization wrote on X alongside examples of Biden's autopen signature.
The Oversight Project is questioning "who controlled the autopen" because "they controlled the presidency."

Following the Oversight Project findings, Missouri Attorney General Andrew Bailey called for the Department of Justice to investigate whether Biden’s "cognitive decline allowed unelected staff to push through radical policy without his knowing approval."

Bailey argued that if the widespread autopen use turns out to be true, "these executive orders, pardons, and all other actions are unconstitutional and legally void."

If Jill Biden or another unauthorized individual secretly signed executive orders using an autopen, knowing that Joe Biden was unaware or incapable of understanding them, this could constitute fraud, and usurpation of executive authority. The specific criminal charges could include false statements, impersonation, and conspiracy to defraud the U.S. government under multiple federal statutes.
