Scholten introduces bill to open Musk and DOGE to FOIA provisions

U.S. Rep. Hillary Scholten (D-Grand Rapids) on Thursday introduced legislation she says will provide accountability about the actions of billionaire Elon Musk and his Department of Government Efficiency, or DOGE.

According to a press release from Scholten’s office, the Consistent Legal Expectations and Access to Records (CLEAR) Act, clarifies that temporary organizations like DOGE are subject to the Freedom of Information Act (FOIA).

“Given the breadth of power these organizations wield, they should be subject to the same standard of scrutiny and public information sharing that other agencies are beholden to,” stated the release.

DOGE was created by President Donald Trump through an executive order using an authority that allows the president to set up “temporary organizations.” Scholten introduced the legislation to make it clear that any organization created in that manner is automatically subject to FOIA requests.

judge blocks doge access to treasury data but it's only temporary as of now and, probably, too late:

Judge Colleen Kollar-Kotelly ruled that Musk and his team could no longer access Treasury data after he boasted on Monday about "rapidly shutting down" certain government remittances. The Treasury’s payment system handles trillions of dollars annually, covering vital programs like Social Security and Medicare. Musk had asserted that these payments were placing an excessive burden on the federal budget.

The court’s decision was driven by concerns over privacy violations. Federal employees and retirees filed a lawsuit arguing that sharing sensitive financial data with D.O.G.E. “deprives them of privacy protections guaranteed by federal law.” The judge responded with a temporary order preventing Musk’s team from further interaction with Treasury records.

"The greatest threat we've ever faced": US Treasury division classifies DOGE staff as extreme danger

"There is ongoing litigation, congressional legislation, and widespread protests relating to DOGE’s access to Treasury and the Bureau of the Fiscal Service,” the email reads, per the tech-focused outlet. "If DOGE members have any access to payment systems, we recommend suspending that access immediately and conducting a comprehensive review of all actions they may have taken on these systems."
