There are roughly 2 million federal government employees. Congress did not appoint all of them. The Senate does confirm certain presidential appointments, such as federal judges, cabinet members, and ambassadors, but they certainly don’t appoint or confirm all employees of the executive branch.

Special government employees under Trump during his first term, Biden, Obama and other previous administrators were not appointed by congress. Like other special employees, Musk became a government special employee without involvement by congress. It was challenged in a lawsuit but that went nowhere. Enjoy.
