Sandy Hook Massacre: Remington and Other Gun Companies Lose Major Ruling Over Liability

The Connecticut Supreme Court dealt a major blow to the firearms industry on Thursday, clearing the way for a lawsuit against the companies that manufactured and sold the semiautomatic rifle used by the gunman in the massacre at Sandy Hook Elementary School.

The lawsuit mounted a direct challenge to the immunity that Congress granted gun companies to shield them from litigation when their weapons are used in a crime. The ruling allows the case, brought by victims’ families, to maneuver around the federal shield, creating a potential opening to bring claims to trial and hold the companies, including Remington, which made the rifle, liable for the attack.

A progressive judge ignoring the constitution again. The next time a terrorist drives a vehicle into a crowd, this same judge will say that the car company is also liable for damages. Probably a gas company as well because the terrorist filled up the tank at a gas station before his attack.

This case will just strengthen the second amendment if it gets to SCOTUS.
 
Yes, and then families of DUI victims can start suing booze and car manufacturers!!!

It just says the suit can move forward and hasn't even gone to SCOTUS yet which it surely will and that's before anyone can actually get to a trial or settlement.
Not really seeing a big deal with it at this point.

ok, for those who can't read or understand...

The suit was brought making all kinds of claims against Remington. It got bumped up to Federal court which dismissed the federal claims because of the laws which protect gun manufacturers from these kinds of suits. The Federal court then sent the case back to the State courts, leaving the State law based claims intact.

You know what those claims are?

Basically, they're product liability claims. The suit claims that Remington made a product which is unsafe and that lack of safety is what caused the school shooting to occur.

IF it survives the motions to dismiss, and a jury decides against Remington, the appeals court will have no choice except to overturn the decision because guns are "inherently dangerous" and manufacturing an "inherently dangerous" item isn't the same as manufacturing a DEFECTIVE product.

IF that's what happens, the plaintiffs (those families who are hurting emotionally because of what a lunatic did) are going to be liable for the costs of the defense by Remington. Usually, that adds up to a few million by the time it's all said and done.

It won't be the first time the parents of the victims were taken advantage of by anti-gun zealots doing this. There was a Colorado case (IIRC) in which the plaintiff still owes the gun manufacturer a few hundred thousand after they lost their suit against the Gun Company.

basis. That way, they won't get anything from their bogus suit, after they lose, and will incur expenses.

The families will be liable for those expenses. The lawyers only "advance" the costs. If the families don't pay, the lawyers will sue them for it under the terms of the retainer agreements and they will win.

The families are going to be the big losers in this game. First they lost their family members. Now they're going to lose everything else.

I've seen this movie before many times. It NEVER turns out well for the victims.
