Why is Merrick Garland Defending Trump?

I understand why Garland is doing what he's doing — he thinks it looks bad for a new administration to knee-jerk reverse the judgments of a previous Justice Department. There's something to that. On the other hand, the previous Attorney General was a senior partner in a criminal enterprise, and his opinion on the necessity of defending a president for pre-presidential wrongdoing was literally insane, Louis XIV "I am the state" shit.

Democratic senators have leverage here if they want to use it. But these are Democrats, so that's unlikely to happen.

Garland has to work past the legacies of the past two AG’s. Not just Barr but Sessions too.
 
Agree. He’s continuing Barr’s policy on the Trump defense and ignoring silly calls to try and groundless my prosecute Trump for 1/6.

He's leading an independent DOJ, which was not Barr's policy at all. As far as I'm aware, no one has called on him to do anything to Trump on anything related to 1/6.

I get that's what you believe it is. Someone who bucks the partisan stream within a month seems fairly demonstrative. There's a reason why Obama nominated him to the SCOTUS.

Sadly, Republicans would've confirmed him if they had any care about that sorta thing outside of their power sphere.

Correct. More specifically, he is protecting the prerogatives of the office of the President, not the personal interests of the asshole who occupied said office.

Incidentally, the AG's in office at the beginning of the terms of the previous three Presidents took similar action with on-going matters.
 
I remember when Ralph Nader was running for president . . . my thinking was always, "I don't want Nader as president! I want Nader as attorney general!" Cue bowels opening in boardrooms all across America!
