According to the following youtube link, it seems Bush Jr's endorsement of the Patriot Act paved the way for any sitting US President to declare Marshall Law. The United States government appears to be doing so. Many believe Obama is exploiting the Patriot Act to his advantage, as did Bush Jr's administration.

like a friend said to me, we haven't had a real free thinking president since kennedy (he was getting ready to pull all advisors out of vietnam and downgrade the cold war before he was killed- anyone believes that one magic bullet that never mushroomed and did that much damage, i have a bridge to sell you CHEAP). all presidents since him have been groomed for the position.
