While Lindell has pushed numerous conspiracy theories to explain Trump's loss, he has mainly focused on voting machines from Smartmatic and Dominion Voting Systems. He has alleged that these machines switched votes from Trump to current President Joe Biden.

However, Smartmatic's voting machines were only used in one U.S. county during the 2020 election, Los Angeles County, Forbes reported. Neither Lindell nor anyone else has yet to produce concrete evidence proving that the machines flipped votes during the election.

In its lawsuit, Smartmatic's attorneys point out that Lindell has published content repeating his claims about their machines on three different websites: FrankSpeech.com, MichaelJLindell.com and LindellTV.com. Each of these websites contains promotion codes and advertising for MyPillow and Lindell's autobiographic book, What Are the Odds? From Crack Addict to CEO.

"A federal judge in Washington on Thursday imposed sanctions on Lindell and his former lawyers as part of a decision throwing out the CEO’s defamation lawsuits against Dominion Voting Systems Inc. and Smartmatic Corp., which were falsely placed at the center of a vast conspiracy theory after the election," said the report.

"Lindell, an outspoken supporter of former President Donald Trump, filed his suit after the companies sued him for defamation over his election-fraud claims," said the report. "Nichols said the CEO failed to properly allege a conspiracy by the two companies or back up his claim that they defamed him. The judge also partially granted Smartmatic’s motion for sanctions and fees. The amount will be decided later."

The pillow magnate had asked the court to dismiss the complaint by arguing the company had failed to adequately make its case for defamation, and his attorneys argued that Lindell's election fraud claims were protected under the First Amendment, but U.S. District Judge Wilhelmina Wright denied the motions to dismiss, reported Politico.
MyPillow also filed a motion arguing that Lindell's statements cannot be attributed to his company, but the judge denied that, as well.
The court ruled that Smartmatic had made sufficient allegations to support its defamation case by demonstrating that Lindell had made knowingly false statements and acted with actual malice, and the judge ruled that MyPillow can be held liable for those claims because he allegedly defamed the tech company while promoting his company.

I have a problem with that. He would have to believe the claims were false and that OrangeBoi lost in an election where there was no fraud at all. I don't believe he believes that. I believe he fully believes his claims, ridiculous as they are.

i can't speak with any authority on this, j, but i'm thinking the 'knowingly' doesn't attempt to address his craziness but the facts that anyone of normal mind would be persuaded by... i.e all the court cases that showed Joe Biden won and there was no outcome-changing fraud.

Sullivan back in 1964, the U.S. Supreme Court under Chief Justice Earl Warren ruled that in a defamation lawsuit, the plaintiff has to prove “actual malice” on the part of the defendant — and making an honest mistake doesn’t qualify as actual malice. The High Court, in that unanimous ruling 58 years ago, made defamation very difficult to prove; former Alaska Gov. Sarah Palin, for example, lost her defamation lawsuit against the New York Times, as her attorneys were unable to demonstrate in court there was actual malice on the Times’ part.
But Smartmatic, in its defamation lawsuit against Lindell and MyPillow, is arguing that Lindell didn’t make an honest mistake — he showed a total disregard for the truth and promoted a conspiracy theory that is divorced from reality.

Not defending him, but we've seen it a number of times. 'Say it enough and some will believe it to be true.' If he believes it to be true (no matter how crazy he may be), his actions may not be 'malicious'. He may honestly be trying to convince others of what he considers to be the truth.


He's trashed his company and spent millions of his own money on this. To me, that's a sign of a true believer, even if he has all of the facts wrong. Jim Jones was a true believer too. Some of those who claim to have been abducted by aliens are or were true believers.There are those who are true believers in BigFoot.

Mr. Lindell knows, as does everyone who supported and voted for Donald Trump in 2020, that he lost the election, fair and square. Even if there was, at one time, doubts about the legitimacy of the election, those doubts have long since been removed as repeated and thorough investigations have proven over and over again that there was no "stolen" election. So, deep down, each and every person who claims that "The 2020 election was stolen from Trump" does not actually, truly believe it; at least not anymore.

So why do they keep saying it? It's not about whether they "Believe" it or not. It's all about power. They supported Trump's agenda and still do. Meaning they want a strong, autocratic and authoritarian white-nationalist government. To them, Trump is the vehicle by which they can make that happen, so they support his lies- which they KNOW are lies, because they wish their strong man dictator to be installed.

An investigation by the progressive watchdog Media Matters found that MyPillow was helping fund at least 17 QAnon-affiliated shows and personalities by offering them a cut of sales made through their sales code.
